IN EXERCISE of the powers conferred by Section 15 (2) of the Export Processing Zones Act, the Cabinet Secretary, Ministry of Industrialization and Enterprise Development revokes the declaration of an Export Processing Zone made in respect of all the pieces of land being L.R. No. 17599/4, L.R. No. 1759915 and L.R. 1759916 measuring in total approximately 0.7206 hectares situated in the City of Nairobi along Nairobi-Kangundo Road.

Legal Notice No. 31 of 2005 is revoked.

IN EXERCISE of the powers conferred by Section 117A of the Customs and Excise Act and Section 24 (4) of the Public Finance Management Act, 2012, the Cabinet Secretary for the National Treasury makes the following Regulations-

THE CUSTOMS AND EXCISE (RAILWAY DEVELOPMENT LEVY)(AMENDMENT) REGULATIONS, 2014

1. These Regulations may be cited as the Customs and Excise (Railway Development Levy) (Amendment) Regulations, 2014.

2. The Customs and Excise (Railway Development Levy) Regulations, 2013, in these regulations referred to as "the principal Regulations", are amended in Regulation 6-

(a) by deleting the word "and" appearing at the end of paragraph (c); and

(b) by inserting the following new paragraph immediately after paragraph (c)-

(cc) the Solicitor-General; and

(c) by renumbering the existing provision as paragraph (1) and adding the following new paragraph-

(2) The person serving as the Corporation Secretary in the Corporation shall serve as the Secretary to the Committee.

3. The principal Regulations are amended in regulation 8 (1) by deleting the words "before the beginning of the financial year to which they relate".

IN EXERCISE of the powers conferred by Section 140 of the Public Procurement and Disposal Act, the Cabinet Secretary for the National Treasury makes the following Regulations:—

THE PUBLIC PROCUREMENT AND DISPOSAL (AMENDMENT) (NO. 2) REGULATIONS, 2014

Citation.
1. These Regulations may be cited as the Public Procurement and Disposal (Amendment) Regulations, 2013.

Sub. Leg.
2. Regulation 16 (3) of the Public Procurement and Disposal Regulations, 2006, in these Regulations referred to as "the principal Regulations", is amended by inserting the word "not" immediately after the words "A person shall".

3. Regulation 12 (11) is amended by inserting the words "role of the" immediately after the word "the".

4. Regulation 55 of the principal Regulations is amended by adding the following new paragraph immediately after paragraph (2)-

(3) A procuring entity that carries out a procurement process through a request for proposal method pursuant to section 76 shall be subject to the procurement thresholds set out in the First Schedule.

(4) The notice inviting an expression of interest prepared by the procuring entity under section 78 shall specify a minimum period of seven days for the submission by tenderers of their expressions of interest.

(5) The requirement for the invitation of expression of interest shall, not apply where the tender committee

(a) a direct request for proposals;

(b) a direct procurement or single source selection;

(c) restricted tendering; or

(d) a request for quotations.
