IN EXERCISE of the powers conferred by section 234 of the Customs and Excise Act, the Cabinet Secretary for the National Treasury makes the following Regulations:—

THE CUSTOMS AND EXCISE (PETROLEUM OILS) (EXCISE) (AMENDMENT) REGULATIONS, 2013

1. These Regulations may be cited as the Customs and Excise (Petroleum Oils) (Excise) (Amendment) Regulations, 2013.

Sub. Leg.
2. Regulation 8(1) of the Customs and Excise (Petroleum Oils) (Excise) (Amendment) Regulations, 2005, in these Regulations referred to as the “Principal Regulations”, is amended—

(a) by inserting the words “or through any other facility licensed by the Commissioner that has a minimum storage capacity of one hundred million litres and is directly connected to the Kenya Pipeline Company Petroleum Pumping System” immediately after the words “Kipevu Oil Storage Facility”;

(b) by deleting the expression “ten” appearing in the proviso and substituting therefor the expression “five”.

3.Regulation 8 (2) of the Principal Regulations is amended by deleting the expression “ten (10)” appearing in the proviso and substituting therefor the expression “five”.

4. Regulation 16 (B)  (a)  of  the  Principal  Regulations  is amended by inserting the words “or at any other facility licensed by the Commissioner that has a minimum storage capacity of one hundred million litres and is directly connected to the Kenya Pipeline Company Petroleum Pumping System” immediately after the word “Mombasa”.

IN EXERCISE of the powers conferred by section 3 (1) of the State Corporations Act, I, Uhuru Kenyatta, President and Commander- in-Chief of the Kenya Defence Forces make the following Order:—

THE INFORMATION AND COMMUNICATIONS TECHNOLOGY AUTHORITY (AMENDMENT) ORDER, 2013

Citation.
1. This Order may be cited as the Information    and Communications Technology Authority (Amendment) Order, 2013.

L.N. 183/2013.
2. The Information and Communications Technology Authority Order, 2013, in this Order referred to as “the principal Order”, is amended in paragraph 2—

(a) by deleting the words “for the” appearing immediately after the expression “Cabinet Secretary” appearing in the definition of “vesting day” and substituting therefor the words “responsible for matters relating to the”.

(b) by inserting the following new definition in proper alphabetical sequence—

“Kenya National Spatial Data Infrastructure Initiative” means the Project under  the Authority to promote the sharing of geographical data throughout the Government, the private and non-profit making sectors and the academic community.

3. The principal Order is amended in paragraph 4—

(a) by deleting subparagraph (h) and substituting therefor the following new subparagraph—

(h) establish, develop and maintain secure ICT infrastructure and systems.

(b) by inserting the following new subparagraph immediately after subparagraph (i)—

(j) implement and manage the Kenya National Spatial Data Initiative.

4. The principal Order is amended in paragraph 6 by renumbering subparagraphs (2), (3) and (4) as subparagraphs (3), (4) and (5), respectively.


5. The principal Order is amended in paragraph 10 by deleting the words “one half plus one” and substituting therefor the words “two- thirds”.

6. The principal Order is amended in paragraph 11(2) by inserting the words “from among the chief executive officers of the former bodies set out under this Order” immediately after the words “commencement of this Order”.

7. Paragraph 23 of the principal Order is amended—

(a) in subparagraph (1)—

(i)  by deleting the words “for Finance” and substituting therefor the words “responsible for matters relating to the National Treasury”;

(ii) by deleting the words “for Interior” and substituting therefor the words “responsible for matters relating to the Interior”.

(b) in subparagraph (5) by deleting the words “for Finance” and substituting therefor the words “responsible formatters relating to the National Treasury”.

8. The principal Order is amended in paragraph 25—

(a) by deleting the words “this Act” appearing in subparagraph

(5) and substituting therefor the words “this Order”.

(b) by deleting subparagraph (6);

(c)  by deleting subparagraph (7).
