In obedience to God’s Command and Will, and guided by the Constitution, to serve humanity, and Kenyans in particular, with dedication, honesty and integrity, striving at all times to uphold the rule of law and do justice to all.

 

 

A.   PERSONAL PROFILE

I am a God fearing person who believes in, and endeavours to do, justice to all irrespective of their status in society. I have a great passion for upholding the rule of law, which is an essential ingredient for social justice, political stability and economic development. I value people as a core resource and have had great pleasure and success in building teams towards effective justice delivery.

I am results-oriented and have worked with a diverse range of partners, committee’s, panels and other bodies to deliver the desired change and results consistently throughout my career to date.I am particularly keen on building a solid leadership pipeline and enabling people to achieve their fullest potential.

In this regard, I have taken up inspirational leadership as a hobby and mentoring young people and professionals as second nature.

I am self-driven with strong organizational and administrative skills and the ability to work independently as well as collaboratively. I particularly pride myself in my ability to positively interact with the various consumers of justice, regardless of their level, to address pertinent issues concerning the justice system. This has resulted in enhanced credibility of the Judiciary in the courts and stations where I have worked.

As a Judge, though I am occasionally provoked to anger by counsel, litigants or witnesses who try to frustrate the court process, I am, however, able to understand their situations, control myself and firmly, yet courteously and fairly, deal with the situation thereby maintaining court decorum. Further, utilizing my fluency in Kiswahili, when I realize that interpretation in court is not effective, I put counsel’s questions to the witnesses in Kiswahili ensuring that the hearings proceed fairly and smoothly. I am also given to kindness; using that gift, I talk to parties especially those who are unrepresented, in order to make sure they are at ease. I explain to them the nature of the cases and ensure they understand what is required of them before we start the proceedings.

As a responsible citizen of Kenya, I am an Elder and one of the Bible-Study leaders of the Seventh Day Adventist Church. I have also served as Member of the Board of Governors of Sironga High School in Nyamira, Njoro Girls High School and Lanet Secondary School.

 

 B. Professional Profile

I am a senior legal professional with extensive experience in the Bar and on the Bench, and with a nascent but growing interest in academia. I was admitted to the Roll of Advocates 38 years ago, and I have served as judge of Kenya’s two Superior Courts for about 13 years.


I have a strong track record both in the Judiciary and private practice, where I have successfully served both as a professional and a leader. I have also been exposed to many different facets of law, varied working environments, people, and communities making me a well-rounded individual.

Anne Atieno Amadi

Anne Atieno Amadi, an advocate of the High Court of Kenya, holds a Masters in Criminal Justice from Boston University, USA, a Bachelor of Laws degree from the University of Nairobi and a Post Graduate Diploma in Legal Practice from the Kenya School of Law.

She holds two other Post Graduate Diplomas, one in Alternative Dispute Resolution from California State University and another in Law of Internal Displacement from the Institute of International Humanitarian Law, San Remo, Italy.

She joined the judicial service as a District Magistrate II (Prof.) in 1990 and rose through the ranks to become a Resident Magistrate before joining private legal practice as Sole proprietor at A. A. Amadi & Co. Advocates between 1997 and 2003.

Mrs Amadi served at Federation of Women Lawyers - Kenya (FIDA) as Deputy Executive Director between 2003 and 2008 and as the National Coordinator of National Legal Aid and Awareness Programme (NALEAP), Ministry of Justice National Cohesion and Constitutional Affairs, between 2008 and 2011. Until her appointment as the Chief Registrar of the Judiciary, she was working as a Consultant.

The Hon. Chief Justice, Dr. Willy M. Mutunga, was appointed to the Supreme Court of Kenya on 22nd June, 2011.  He is a holder of a Doctorate Degree in Jurisprudence obtained in 1992 from Osgoode Hall law School at York University in Toronto, Canada.  His area of study was Contracts.   Dr. Mutunga obtained both his Bachelor of Laws (Honours) and Master of Laws degrees from the University of Dar-es-Salaam in Tanzania in 1971 and 1974 respectively.

Dr. Mutunga joined the University of Nairobi as a lecturer in the Faculty of Law in October 1974.  While at the University of Nairobi, he served as the secretary-general of the University Staff Union from April 1979 until July 1980 when it was banned.  Dr. Mutunga was thereafter detained for 16 months (1982-3) for his activism while at the University of Nairobi and for his work at the Legal Advice Centre (Kituo Cha Sheria). 

Dr. Mutunga has established and served in many civil society organizations, among them the Legal Advice Centre (Kituo Cha Sheria); the Law Society of Kenya, where he served as vice-chairman from 1991 to 1993 and chairman from 1993 to 1995; the Council for Legal Education, Kenya; the Citizens Coalition for Constitutional Change (4Cs); the Kenya Human Rights Commission; the East African Centre for Constitutional Development (Kituo Cha Katiba), Uganda; and the International Centre for Human Rights and Democratic Development (Rights and Democracy) in Montreal, Canada.

For his outstanding contribution to the development of law, human rights, good governance and social justice, Dr. Mutunga has received several national and international honours and awards including: Elder of the Golden Heart for his distinguished service to the nation and for his role in leading reforms in the Judiciary under the new Constitution (2012); appointment as Senior Counsel, Government of Kenya (2003); Lifetime Achievement Award for the Protection and Promotion of Human Rights from the Kenya National Commission on Human Rights, (2003); the Jurist of the Year Award from the International Commission of Jurists, Kenya Section (2003); and the Law Society of Kenya Distinguished Services Award for Constitutionalism, Rule of Law and Human Rights, later named the Father Kaiser Award (1988).

Between 2004 and 2011, Dr. Mutunga wrote a column in the Sunday Nation newspaper under the pen name of Cabral Pinto.  Charles Onyango-Obbo is currently editing a compilation of these writings.

Dr. Mutunga has published two books: The Rights of Arrested and Accused Persons (Nairobi: Oxford University Press, 1990) and Constitution-Making from the Middle: Civil Society and Transition Politics in Kenya, 1992-1997 (Nairobi and Harrare: Sareat/MWENGO, 1999).  He has also published many essays and papers on human rights, law and society and co-edited and co-authored several books: Governance and Leadership: Debating the African Condition: Mazrui and His Critics, Vol.1 and Vol. 2, (Africa World Press, 2003) with Alamin M. Dr. Mutunga is an avid reader, is fond of Indian movies and documentaries on revolutionaries, and religiously meditates and practices yoga. He wishes he could swim more often.

Hon. Lady Justice Kalpana H. Rawal was the Deputy Chief Justice and the Vice President of the Supreme Court of Kenya. She was sworn into office on June 3, 2013 in a ceremony presided over by the His Excellency the President of the Republic Kenya and the Chief Justice of Kenya.

Justice Rawal hails from a long line of distinguished lawyers. Her father was a retired Judge of the Senior Court of Gujarat and her grandfather was Deputy Law Minister in the State of Kutch, India. She holds a Bachelor of Arts degree, and Bachelors and Master of Laws in constitutional and administrative law. She received her LLB and LLM degrees in India, where she practised for three years under the tutelage of the then Chief Justice of the Gujarat High Court, Justice P. N. Bhagwati, who later became the 17th Chief Justice of India.

Justice Rawal has over 40 years experience in the legal profession. She migrated to Kenya in 1973, and after being exempted by the Legal Council from appearing in any exams, she was enrolled as an Advocate of the High Court of Kenya in July, 1975. Prior to that, she worked as a teacher of both administration and regular police officers at Lower Kabete. Also in 1975, she set up a private practice under the name of K. H. Rawal Advocates becoming the first woman lawyer to do so in Kenya. She ran her practice until 1999 when she was appointed a Commissioner of Assize. A year later, she was appointed as a Judge of the High Court of Kenya. During her tenure, she reformed each of the Divisions in which she was appointed - Civil, Criminal, Family, Environmental and Land Law – by reducing severe backlog and improving the expeditious disposal of cases. 

In April, 2010, Justice Rawal was appointed as the Liaison Judge for Kenya making her a member of the International Hague Network of Judges. The Hon. Chief Justice of Kenya also appointed her to assist the International Criminal Court (ICC) to take evidence of security officers in respect of the investigation into Post Election Violence in 2007-2008. Under her guidance, the Rules of Procedure under the International Crimes Act No. 16 of 2008 were promulgated expeditiously and have resulted in ground breaking decisions in the said field of law.

In January 2012, Justice Rawal was sworn in as a Judge of the Court of Appeal after a competitive and open process.

In June 2012, Justice Rawal was appointed by H. E. the President of Kenya to Chair the Commission of Enquiry into the causes and circumstances surrounding and leading to a fatal accident, which occurred on 10th June 2012 in Kibikio, Ngong Forest. The Accident involved a Kenya Police helicopter, aircraft registration 5Y-CDT type AS 350B3, which killed all six people on board, including the then Minister of Internal Security, Professor George Saitoti and his Assistant Minister, Orwa Ojode. The process of the enquiry has been commended as an open, transparent and inclusive enquiry.  On 28th February, 2013 Justice Rawal presented the Enquiry Commission’s Report to H. E. the President of the Republic of Kenya.

On 11th December 2012, H. E. the President of the Republic of Kenya, in recognition of her service to the Nation, awarded Justice Rawal with Elder of the Order of Burning Spear (EBS).

Justice Rawal is a loving wife, caring mother of two and proud grandmother of three.

Justice Philip Tunoi was appointed to the inaugural Supreme Court on June 11, 2011. He had previously served as Judge of the Court of Appeal since 1993, and as High Court Judge since 1987.

After graduating with a bachelor’s degree in law from the University of East Africa, Dar-es-Salaam, Justice Tunoi was admitted to the Roll of Advocates in Kenya. He holds a master’s degree in philosophy from the University of Nairobi, where he is also completing his doctoral degree in the same discipline.

He served as the Provincial State Counsel for Nyanza and Western provinces from 1970 to 1973 before going into private practice until 1987.

He is the Vice President, East African Court of Justice and the former Chairman of East Africa Judges Training Committee. He has been a member of the Kenya National Council for Law Reporting, Rules Committee East Africa Court of Justice, Senior Judges Committee-Africa, National Crime Research Governing Council and UN Drugs Control Programmes, Judicial Sector, Pretoria.

Mrs. Gladys B. Shollei is the immediate former Chief Registrar of the Judiciary. Mrs. Shollei, holds a Master of Laws Degree (LLM) from University of Cape Town; a Master of Business Administration Degree (MBA) from Jomo Kenyatta University; a Bachelor of Laws Degree (LLB) from University of Nairobi, a Diploma in Law from the Kenya School of Law, is an Advocate of 17 years standing and a Certified Public Secretary (CPS). 

Prior to her appointment as the Chief Registrar of the High Court, she served as Deputy Chief Electoral Officer at Interim Independent Electoral Commission (IIEC) and was an advocate of the High Court for 15 years standing. She is also credited with having established the National Council of Law to a fully functional state corporation. She also set up the infrastructure for online publication

She studied law at the Universities of Nairobi and Cape Town and has taught Civil Procedure, Criminal Procedure, Child Law, Trial Advocacy and Local Government Law as well as having undertaken consultancies for global organizations including the United Nations Environment Programme (UNEP). She was the Editor of the Kenya Law Reports and has also published in the area of Child Law as well as participated in international, regional, national and local conferences. She has also served as Faculty Moot Court Advisor, Judge and Team Coach for the two most prestigious Moot Court Competitions in the world, i.e., The Jessup International Moot Court Competition and the African Human Rights Moot Court Competition. She is a duly registered doctoral candidate at the University of Ghent in Belgium.

Mrs. Shollei's term ended on October 18, 2013.

Rtd. Justice Johnson Evan Gicheru

The Honourable Mr. Justice Johnson Evan Gicheru was appointed Judge of the High Court of Kenya in 1982. After 6 years as a puisne Judge, Mr. Justice Gicheru was appointed as a Judge of the Court of Appeal on 8th June, 1988, where he served until 21 st February, 2003 when he was appointed the Chief Justice of the Republic of Kenya.

His term as Chief Justice ended on February 27, 2011 pursuant to paragraph 24 of the Sixth Schedule to the Constitution of Kenya 2010.

Prior to his judicial appointment, Mr. Justice Gicheru had worked as Senior State Counsel in the Office of the Attorney-General and as an administrative officer in the Office of the President.

The Chief Justice is remembered for his firm and judicious Chairing of the 1990-91 Judicial Commission of Inquiry into the Disappearance and Death of the then Minister for Foreign Affairs, Dr. Robert Ouko.

At the time when he was appointed to the office of Chief Justice, Kenya’s Judiciary was on the spotlight of the national and international media and on the threshold of judicial reforms on a scale not previously witnessed elsewhere in the modern world. “ Steering the Judiciary through these unprecedented reforms and thereafter keeping abreast of contemporary best practices in the administration of justice has been a great challenge”, he says.

The Chief Justice is also renowned for his efforts in entrenching integrity within the Judiciary, streamlining the processes of the Court, the independence of judicial officers as well as the operational and financial independence of the Judiciary as an arm of the government.

Mr. Justice Gicheru is married to Mrs. Margaret Gicheru and they have 7 children.
