THE NATIONAL ASSEMBLY ELECTIONS (ELECTION PETITION) RULES

APPOINTMENT OF ELECTION COURT

IN EXERCISE of the powers conferred by section  60  (5) of the Constitution of Kenya and section  19  of the National Assembly and Presidential Elections Act, the Chief Justice of the Republic of Kenya appoints an election court comprising of Lady Justice Philomena M. Mwilu, to hear the election petition whose details are given hereunder in the High Court of Kenya at Nairobi.

VACANCY FOR THE OFFICE OF (1) CHIEF JUSTICE AND (2) DEPUTY

CHIEF JUSTICE

The Judicial Service Commission of Kenya invites applications from qualified persons for the following positions in the Judiciary:

1. CHIEF JUSTICE OF THE REPUBLIC OF KENYA (1  POST)

Ref. V/No. 1/2011

Terms of Service: Constitutional Office

Period of Service: Maximum ten years subject to retirement age of

seventy (70) years

Functions:

The Chief Justice shall discharge the following functions:

(a) Be the Head of the Judiciary.

(b) Be the President of the Supreme Court.

(c) Convene and Chair the Judicial Service Commission meetings.

(d) Be the link between the Judiciary and other arms of Government.

(e) Assign duties to the Deputy Chief Justice, the President of the Court of Appeal, the Principal Judge of the High Court and the Chief Registrar of the Judiciary.

(f) Give an annual report to the Nation on the state of the Judiciary and the administration of Justice.

(g) Exercise general direction and control over the Judiciary.

(h) Chair the National Council on Administration of Justice.

(i) Oversee the management and administration of the Judiciary Fund.

(j) Discharge any other functions as required of him or her by the Constitution and any other legislation.

Constitutional and Statutory Requirements for Appointment:

For appointment to the position of Chief Justice, the applicants must be in possession of the following minimum qualifications:

(a) Hold a law degree from a recognised university or are an advocate of the High Court of Kenya or possess an equivalent qualification in a common-law jurisdiction.

(b) Possess at least fifteen (15) years experience as a Superior Court Judge or a distinguished academic or a Judicial Officer or a Legal Practitioner in other relevant legal field, or

(c) Hold the outlined qualifications in (a) and (b) above for a period amounting, in the aggregate, to fifteen (15) years.

(Experience gained in Kenya or in another Commonwealth Country with a common-law jurisdiction will be considered).

(d) Have a high moral character, integrity and impartiality.

In addition to the above qualifications, the candidates must have demonstrated a high degree of professional competence, communication skills, fairness, good temperament, making good judgements in both legal and life experiences, and commitment to public and community service.

2. DEPUTY CHIEF JUSTICE OF THE REPUBLIC OF KENYA (1 POST)

Ref. V/No. 2/2011

Terms of Service: Constitutional Office

Functions:

The Deputy Chief Justice shall discharge the following functions:

(a) Deputise the Chief Justice.

(b) Be the Vice-President of the Supreme Court.

(c) Be responsible to the Chief Justice in the exercise of the duties assigned to him or her.

(d) Discharge any other functions as required of him or her by the Constitution and any other legislation.

Constitutional and Statutory Requirements for Appointment:

For appointment to the position of Deputy Chief Justice, the applicants must be in possession of the following minimum qualifications:

(a) Hold a law degree from a recognised university or are an advocate of the High Court of Kenya or possess an equivalent qualification in a common-law jurisdiction.

(b) Possess at least fifteen (15) years experience as a Superior Court Judge or a distinguished academic or a Judicial Officer or a Legal Practitioner in other relevant legal field, or

(c) Hold the outlined qualifications in (a) and (b) above for a period amounting, in the aggregate, to fifteen (15) years.

(Experience gained in Kenya or in another Commonwealth Country with a common-law jurisdiction will be considered).

The Chief Justice and the Deputy Chief Justice shall be appointed in accordance with the provisions of Article  166  (1) (a) of the Constitution read with section  24  (2) of the Sixth Schedule.

Interested and qualified persons are requested to make their applications by forwarding the following:

(1) A letter of application,

(2) A detailed and updated curriculum vitae summarizing the applicant s bio-data including; background information (such as community service, financial discipline, pro bono activity, involvement as a party in litigation and involvement in political activity including any financial contribution to any political party/parties and criminal record) legal education, legal practice / engagement for the last five (5) years, three (3) professional references and two (2) character references who can verify and comment on the applicant s past and present employment,

(3) Completed Application for Employment Forms in triplicate  -JSC  2A (for public officers) or JSC  2  (for other applicants),

(4) Five (5) samples of any writings by the applicant, including but not limited to Judgements, scholarly writings or any legal publications that the applicant has authored,

(5) The applicant s three recent coloured passport size photographs,

(6) Declaration of income and liabilities as at the time of making the application, using the prescribed forms. For those who are in Government employment, attach copies of returns of declaration of income and liabilities and for those in private practice attach income tax returns, for the last three (3) years,

(7) Certified copies of testimonials and professional certificates and academic transcripts,

ADDENDUM  1: RUIRU WATER SUPPLY PROJECT, RUIRU

MUNICIPALITY

INVITATION OF PUBLIC COMMENTS

PURSUANT to regulation  21  of Environmental (Impact Assessment and Audit) Regulations, the National Environment Management Authority, (NEMA) has received an environmental impact assessment study report for the implementation of the proposed Ruiru Water Supply project.

The project involves construction and commissioning of the Ruiru water supply project that will supply to the residents of Ruiru town up to  10,000m3  of water per day.

The proposed project intakes works is located at the confluence of Ruiru and Komothai Rivers next to Coffee Research Foundation, within Ruiru District.

The project anticipates the following impacts and mitigation measures:

Physical setting, flora and fauna

Provide structures that will not hinder free movement of animals.

Structure shall not block drainages.

Grade sites to original levels to maintain topography.

Compensation/replacement for uprooted cash crops destroyed.

As much as practical limit the amount of vegetation cleared during works.

Interruption of key infrastructure installations

Establish the nature of all stakeholders.

Identify key interests of each of the stakeholders.

Formally liaise with the stakeholder and communicate the project details to them with a view of developing a work plan.

Implement work plan.

Acquire Certificate of Satisfactory

Works Completion.

Compensation and land take

Land take shall be minimized where feasible, exploring all viable alternative project designs e.g. realignment of the pipeline may significantly reduce compensation.

Where displacement is unavoidable, plan for compensation plans shall be developed with adequate compensation.

Noise and vibrations management

Construction activities limited to between  7  a.m. to  6  p.m..

All equipment used during the construction phase to be regularly maintained to ensure efficient operation;

Noise dampening materials to be used where excessive noise generating-equipment are in use.

Use of appropriate cushioning for heavy equipment.

Use of personal protective equipment by staff.

Water and energy management

Provide appropriate and adequate drainage infrastructure where required.

Ensure machinery is regularly serviced to avoid leakages and/or spillage.

Oils, fuels and other materials to be stored in accordance with the manufacturers safety data sheets (MSDS).

Train staff on spill response.

Implement erosion and sedimentation controls.

Energy management through use of sound equipment.

Application of rated equipment in welding and related works.

Use of efficient mechanical plant and energy savers on sites.

All wastes shall be regularly cleared from the site and disposed of in approved manner.

High level of housekeeping shall be maintained.

Staff shall be trained/sensitized about waste management at the start of the project and regularly as may be found appropriate.

Erosion and sediment management

Develop an erosion and sediment control plan prior to commencement of works.

Design erosion control structures to address operational erosion incidences;

Provide for proper storage and sanitation utilities on site.

Provide for run-off water diversions as appropriate.

Plan for motorized machinery movement with limited disturbance of soil.

Maintain as much vegetation as may be practical at work sites.

Take corrective measures on noticing indication of land degradation.

Follow procedures for chemical handling and dispensing.

Enhance the staff appreciation through regular review and onsite training.

Occupational health and safety

Liaise with the Directorate of

Occupational Health and Safety

Department to provide for appropriate induction training and regular updating of worker skill on occupational health and safety matters.

Provide for appropriate signage and warnings at work sites.

Use personal protective equipment (PPE) to workers and any visitors.

Provide for First Aid facilities as per the

OSHA.

Provide and clearly display emergency contacts.

Develop and implement a detailed and site specific emergency response plans.
