THE NATIONAL ASSEMBLY STANDING ORDERS
SPECIAL SITTINGS OF THE NATIONAL ASSEMBLY
PURSUANT to the provisions of Standing Order 29 (3) of the Standing Orders of the National Assembly, it is notified for the information of the Members of the National Assembly and the general public that special sittings of the Assembly shall be held in the National Assembly Chamber in the Main Parliament Buildings, Nairobi, on Wednesday, 8th April, 2020, commencing at 10.00 a.m., for purposes of—
(a) conveyance of a Message relating to the nomination of a person for appointment as the Chief Executive Officer of the National Government Constituencies Development Fund Board;
(b) conveyance of any other Messages from the Senate and/or the National Executive;
(c) laying of the Public Finance Management (COVID-19 Emergency Fund Response ) Regulations, 2020;
(d) laying of Supplementary Estimates for the Financial Year 2019/20 and related documents;

REGULATORY IMPACT STATEMENT ON THE PROPOSED PUBLIC
FINANCE MANAGEMENT (NATIONAL TOLL FUND) REGULATIONS, 2020
PURSUANT to section 8 of the Statutory Instruments Act, 2013, the National Treasury and Planning has prepared a regulatory impact statement for the draft Public Finance Management (National Toll Fund) Regulations, 2020. The policy objective sought to be achieved by the National Toll Fund Regulations, 2020, is to promote sustainable funding and administrative mechanisms for the implementation of toll road projects in Kenya under the public private partnerships framework.
The proposed regulatory instrument and copies of the regulatory impact statement may be obtained or inspected at the Public Private Partnerships Unit Offices on the 6th Floor, Kenya Reinsurance Plaza on Taifa Road, Nairobi, during working hours, or downloaded from the National Treasury Website: www.treasury.go.ke or the PPP Unit website: www.pppunit.go.ke. Comments and further consultations on the statement may be channeled through the email address info@pppunit.go.ke or jchesoni@pppunit.go.ke.

WHEREAS Justus M’Murithi M’Bagiri (deceased), is registered as proprietor of all that piece of land situate in the district of Meru known as Ntima/Igoki/1227, and whereas the High Court of Kenya in succession cause No. 165 of 2013, has issued grant of letters of administration and certificate of confirmation of grant in favour of Jema Karimi and whereas the said court has executed an application to be registered as proprietor by transmission R.L. 19, and whereas the land title deed of the said piece of land issued in respect of Justus M’Murithi M’Bagiri (deceased) is lost, notice is given that after the expiration of thirty (30) days from the date hereof, provided no valid objection has been received within that period, I intend to dispense with the production of the said land title deed and proceed with registration of the said application to be registered as proprietor by transmission R.L. 19 in the name of Jema Karimi and upon such registration the land title deed issued earlier to the said Justus M’Murithi M’Bagiri (deceased), shall be deemed to be cancelled and of no effect.

WAIVER OF PAYMENT OF SINGLE BUSINESS PERMIT FOR ALL NEW
BUSINESSES
NOTICE is given to the public that the Governor of Nairobi City County Government has, pursuant to Executive Order No. 1 of 2020 and Executive Order No. 2 of 2020, waived the requirement to obtain the Single Business Permit and associated fees for all new business registered/incorporated for the next two (2) years (24 months), effective from 1st March, 2020.
The objective of the waiver is to streamline Business Registration Process in reducing the number of procedures and cost especially for starting small and medium scale businesses and make the City and the Country more attractive and Competitive Investment Destination.
This waiver is aimed at promoting the President’s Big 4 Agenda and his commitment on Access to Government Procurement Opportunities (AGPO) for the Youth, Women and Persons with Disabilities.
A valid Certificate of Registration/Incorporation or Business name issued by the Business Registration Service shall serve as Business Permit during the first two years of registration for purposes of enforcing this order. However, the waiver does not override the need to comply with other existing legal requirements for businesses.

INTENTION TO PREPARE WOTE MUNICIPALITY INTEGRATED
DEVELOPMENT PLAN AND WOTE MUNICIPAL SPATIAL PLAN
NOTICE is given to all residents and stakeholders within Wote Municipality, Makueni County that pursuant to the provisions of the Physical and Land Use Planning Act, 2019, the County Governments Act, 2012 and the Urban Areas and Cities Act, that Wote Municipality in conjunction with the Government of Makueni County intends to prepare the Wote Municipality Integrated Development Plan (IDeP) and the Wote Municipal Spatial Plan.
Whereas the purpose of IDeP is to provide an overall Wote Municipality integrated framework for municipality’s urban growth and a basis for co-ordinated programming of projects and budget, the municipal spatial plan will provide a spatial framework with policies and development proposals to guide and control development and to ensure orderly, co-ordinated, harmonious and progressive development of infrastructural facilities and services for socio-economic development.
The Municipality of Wote and the County Government of Makueni shall hold adequate stakeholder meetings in the municipality before the completion of the plan. Any comments, enquiries or suggestions on the same may be done in writing to the Wote Municipal Manager, P.O. Box 78–90300, Wote.

FOR THE PROPOSED SMALL SCALE DREDGING AND
DUMBING IN MWACHE AND MREZA BRIDGE-TSUNZA
VIADUCT-MTEZA BRIDGE, KWALE COUNTY
INVITATION OF PUBLIC COMMENTS
Pursuant to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.
The proponent, Fujita Corporation, Kenya Branch, is proposing to undertake small-scale dredging and dumping in Mwache Bridge- Tsunza Viaduct-Mteza Bridge, Kwale County. The proposal is part of the Mombasa Port Area Road Development Project (MPARD) Package II and will mainly involve dredging of Mwache and Mteza creeks to enable construction of Mwache and Mteza bridges. The area to be dredged in Mwache is approximately 13,561.3m² and the estimated volume of material to be removed is 35,056.09m³ while the area to be dredged in Mteza is approximately 46,764m² and the estimated volume of material to be removed is 134,101.31m³. The dredged materials will be disposed within four identified mudflat areas.
Impacts Proposed Mitigation Measures
Impact of dredging on water quality
• Dredging should be conducted during high tide in order to allow some turbid water to be mixed by the movements of the tidal waters.
• Use of silt curtains to localize turbidity to the dredging area.
• Determine the acceptable critical limits for water quality during dredging based on the baseline values.
• Develop and implement a water quality monitoring plan and share results with the stakeholders on a weekly basis.
Impact of dredging on biodiversity
- Active dredging should be conducted between the months that local fisher folks express low catch landings at BMUs.
• Use of silt curtains to localize turbidity to the dredging area.
• Develop and implement a biodiversity monitoring plan and share the results with stakeholders on a weekly basis.

INVITATION OF PUBLIC COMMENTS
Pursuant to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.
The proponent, Shan Zhang Company Limited, is proposing to carry out small scale copper mining in approximately 6 acres piece of land in Ndwila Village, Kwa Vonza/Yatta Location, Kitui County.
Impacts Proposed Mitigation Measures
Respiratory disease to workers and nearby animals, interference with photosynthesis
• Constant sprinkling of water to the bare areas.
• Identify wind direction during operation to avoid exposure to emission.
• Minimize the generation of bad emission from trucks used by assessing and evaluating whether they contain toxic by products.
• All the workers should be provided with masks to avoid inhaling such gases.
• Develop a respiratory monitoring programme for the mine workers
- To limit exposure level, practice duty controls.
Soil pollution and soil deposition
- Avoid soil transport from the mine to avoid soil contamination with heavy metals.
• Use grasses to rehabilitate the site since they withstand soil contamination better.
• Silt fence should be established where erosion is predetermined.
• Introduce vegetation in already mined areas.
• Introduce physical barriers such as rocks to intercept soil material from being carried away by the run-off.
Loss of vegetation and loss of animal dwellings
• Minimize area of clearance.
• Reintroduce the vegetation that coexist with the site.
• Minimize earthworks.
• Reduce noise at the source.
• Allow wild game to migrate
Noise and resulting vibrations
• Avoid rock blasting.
• Reduce noise at the source point.
• Mining should only be done during the day time.
• Planning the trips of the vehicles can reduce such impacts.
• Screening using baffle moulds material e.g. soil and wastes that has already been remove to access the rock.
• Locate screening baffle moulds on site boundary to reduce noise.
• The workers to be provided with earmuffs during operation hours.
• Supervision of the site by a person with knowledge of dangerous mining activity and accepted mining practices.
• Correct stemming will aid the control of ground vibration.
• Monitoring of blasting if it is used.
• Avoid blasting in adverse weather conditions.
Visual intrusion
- Backfilling the mined pits using earth excavated wastes
Solid and effluent wastes (Oil and other spills)
- Soil and earth excavated wastes to be used for backfilling excavated pits.
• Surface run-off from waste pits should be captured and treated to remove suspended solids prior to discharge.
• Safe disposal of oil spills and filters from machineries.
• Prompt clean up in case of spills
Change on land/loss of land
• Backfill the mined pits.
• Fence the area and allow natural regeneration.
• Aid in revegetation using suitable species.
• Stabilize the soil PH for quick recovery.
Water pollution
- Treat water in the pits of heavy metals before discharge to the environment.
• Harmonize and design drainage ditches with the natural drainage to avoid affecting nearby land.
- Divert run-off around working area.
• Install sedimentation traps or screen next to the silt fence by arranging a layer of stone chips and gravel to trap any loose soil to the river.
• Strictly avoid sub-surface/underground mining technique.
Occupation health and safety
• Fence off the mine site.
• Post cautionary signages at the mine site.
• Isolate the working site from the rest of the community for their safety.
• All depressions should be filled and replanted.
• All moving parts of machine should be covered with suitable guards.
• Keep accidents and incidents records.
• Provide, and enforce use of personal protective equipment and trained on occupational health.
• Fire-fighting equipment and First aid kits should also be provided at the site
Land restoration and landscaping
- Filling in the depressions and mined pits before moving to another section to prevent ponding.
• Landscaping and replanting of trees and other similar vegetation.
• All pits where water may collect to form ponds should be filled.
• A layer of top soil should be introduced so as to achieve vegetation growth

The proponent, Perfect Purity Gases Company Limited, is proposing to set up an industrial gases plant for; (oxygen, nitrogen, acetylene food grade carbon dioxide and argon), two workshops, office block, power house and other associated facilities and amenities located on a plot L.R. No. Machakos/Nguluni/4867, Kangundo Road on Nguluni Area within Machakos County.
Impacts Proposed Mitigation Measures
Excessive noise and vibration
- Construction works should be carried out during working hours, as from 8.00 a.m.–5.00 p.m.
• Machinery and equipment should be well maintained to reduce noise.
• Workers should be provided with PPE’s e.g. ear muffs when operating noisy machinery.
• Consider noise levels when purchasing machinery.
• Plant layout should be established taking into consideration minimal sound generation.
Dust and air emissions
- Workers should be provided with PPE’s e.g. nose masks and goggles during construction.
• Regularly sprinkling water on areas generating dust.
• Ensure use of best technology of gas plants.
• Air emissions from plant should be monitored and analysis undertaken periodically.
Drainage Problems, water wastage and contamination
• Design should ensure surface flow is drained suitably into the public drains during construction.
- Drainage channels should be installed in all areas that generates or receives surface water e.g. car park, along the building block edges of the roofs.
• Ensure all float valves are set within operating ranges.
• Run cooling/boiler tower at optimum concentration cycles to minimize water discharge.
• Utilize decanting and filtration before discharging waste water to water body.
• Monitor and undertake water quality tests periodically including for heavy metals, pH, temperature, to ensure effluent is of acceptable quality.
Solid and liquid waste generation
Non usable solid waste materials generated during construction shall be transported to a NEMA designated dumping site.
• Engage a reputable, NEMA approved solid waste handler for appropriate disposal.
• Ensure packaging materials are thoroughly cleaned and reused.
• Liquid waste storage tanks should be funded to 110% capacity of tank.
• Different liquid wastes should be segregated, marked and recorded before appropriate disposal by NEMA approved disposer.
Occupational risks, fire safety and health
- The implementation of safety measures and emergency plans to contain accident risks associated with construction activities.
• All staff to be trained on use of any unfamiliar machinery and equipment that may pose danger to the user before they use them
- Provision of PPE’s including safety boots, overalls, helmets goggles, earmuffs, masks, gloves.
• Provide a fully equipped first aid kit.
• Provision of Workmen’s Compensation insurance cover.
• Provision of sanitary facilities.
• Appropriate warning signage within facility.
• All works should be supervised by an expert including electrical , structural engineers, chemist.
• Protecting the site from a fire outbreak will be achieved through sound engineering, reliable operations, trained employees, good preventive and predictive maintenance techniques and commitment to safety.
• The proponent and contractor should provide firefighting equipment during the construction phases.
• Sensitize workers on fire risks and ensure they have access to communication facilities for quick emergency response.
• Use fire proof materials e.g. silk paint.
• Provide emergency numbers at strategic points including for police, ambulance.
• Provide a secure area/room to store valuable items of workers ensure regular inspection and maintenance of entire plant.
• Provide emergency assembly point.
• Provide automatic fire fighting system.
• Provide adequate fire extinguishers.
• Ensure all workers are trained in basic first aid, firefighting and handling of chemicals.
• Ensure all lights and electrical fittings are flame proof.
High energy usage
Switch off all electrical appliances and lights when not in use.
• Provide notices and information signs on means and” needs to conserve electricity e.g. Switch Off Lights When Not In Use”.
• Optimize operations of electrical equipment to enhance energy conservation.
• Use energy saving bulbs/fluorescents for general lighting.
• Make use of alternative sources of energy such as solar power.
• Provide an emergency generator which should be installed in a sound proof area.
• Ensure use of best technology of gas plants to minimize energy use.
- Regularly service and maintain plants
Avoid excessive use water at site and encourage reuse and recycling.
• Rainwater harvesting system should be provided.
• Provide notices and information signs on means and needs to conserve water.
• Install water conserving taps that turn off automatically when water is not in use.
Oil leaks
Improve maintenance and design of compressors.
• Oils should not enter drainage system.
• Provide a spillage control drainage system within workshops that is independent of drainage leading to sewer system.
• Provide funding for each compressor and transformer.
• Used oils should be stored in labelled drums and over a catch pot area.
• Engage a NEMA approved used oil disposer.
• Avoid vapor emission by cooling.
• Oils should never be mixed with other substances.
• Provide adequate oil water separator in water soluble emulsifiers is not used.
Traffic risks
- Ensure that all vehicles supplying materials to the site are insured and road worthy.
• Set aside parking area for delivery trucks.
• Put up signboard informing of construction activity at entrance of proposed site.
• Provide a security guard at entrance to control movement of traffic in and out of the compound.
