TASKFORCE ON THE NATIONAL RISK ASSESSMENT (NRA) ON MONEY LAUNDERING AND TERRORISM FINANCING

APPOINTMENT

WHEREAS Kenya is a member of the Eastern and Southern Africa Anti-Money Laundering Group (ESAAMLG) which is an Associate Member of the Financial Action Task Force (FATF);

WHEREAS the mandate of the Financial Action Task Force (FATF) is to set standards and to promote effective implementation of legal, regulatory and operational measures for combating money laundering, terrorist financing and the financing of proliferation, and other related threats to the integrity of the international financial system (the FATF Recommendations);

WHEREAS the Financial Action Task Force (FATF) Recommendations set out a comprehensive and consistent framework of measures which countries are required to implement in order to combat money laundering and terrorist financing, as well as the financing of proliferation of weapons of mass destruction; and

WHEREAS Recommendation 1 of the Financial Action Task Force (FATF) Recommendations require countries to identify, assess and understand the money laundering and terrorist financing risks for the country, and to take action, including designating an authority or mechanism to coordinate actions to assess risks, and apply resources, aimed at ensuring the risks are mitigated effectively and based on that assessment, countries are required to apply a risk-based approach (RBA) to ensure that measures to prevent or mitigate money laundering and terrorist financing are commensurate with the risks identified:

THEREFORE, IT IS notified for general information of the Public, that the Cabinet Secretary for the National Treasury and Planning, in consultation with the relevant Ministries, Departments, Agencies (MDAs) and other stakeholders, appoints a Task Force on National Risk Assessment on Money Laundering and Terrorism Financing (Task Force), consisting of members from the following organisations.

  1. The National Treasury and Planning — (Chairperson);
  2. Financial Reporting Centre (FRC) — (Co-ordinator);
  3. Central Bank of Kenya (CBK);
  4. Anti-Narcotics Unit (ANU);
  5. Anti-Terrorism Police Unit (ATPU);
  6. Asset Recovery Agency (ARA);
  7. Banking Fraud Investigations Department/Unit (BFID);
  8. Betting and Licensing Control Board (BCLB);
  9. Business Registration Service;
  10. Capital Markets Authority (CMA);
  11. Directorate of Criminal Investigations (DCI);
  12. Ethics and Anti-Corruption Commission (EACC);
  13. Insurance Regulatory Authority (IRA);
  14. Kenya Bankers Association (KBA);
  15. Kenya National Bureau of Statistics (KNBS);
  16. Kenya Revenue Authority (KRA);

The Taskforce shall facilitate the conduct of Kenya’s National Risk Assessment on Money Laundering and Terrorism Financing (NRA). Specifically, the Taskforce shall—

(a)        undertake the necessary preparatory work for the National Risk Assessment on Money Laundering and Terrorism Financing (NRA);

(b)        co-ordinate and conduct the NRA exercise;

(c)        identify and assess the level and trends of money laundering (ML) and terrorist financing (TF) risk in the country;

(d)        discuss with, and hold meetings with concerned Ministries, Departments and Agencies (MDAs) and other concerned parties and stakeholders to assess and understand the level and trends of money laundering (ML) and terrorist financing (TF) risk in their respective areas of operations and the MDAs and other concerned parties and stakeholders include, but not limited to the following.

(a)        identify the threat posed by money laundering (ML) and terrorist financing (TF) to the country;

(b)        collect, input and analyse data to facilitate identification of the risks, threats and vulnerabilities on money laundering and terrorism financing;

(c)         determine the vulnerability of financial institutions and designated non-financial businesses and professions (‘DNFBPs’) to ML and TF;

(d)        identify areas for strengthening the country’s Anti-Money Laundering/Combating the Financing of Terrorism (AML/CFT) legal and regulator regime;

(e)         engage with various agencies, parties and stakeholders of meetings for purpose of the exercise;

(f)         collaborate with Development Partners on the NRA exercise and to receive such support, technical or otherwise as the Taskforce may require;

(g)        prepare the NRA report;

(h)        develop a National Strategy on combating Money Laundering and Financing of Terrorism;

(i)         make legislative, administrative or any other recommendations to address any gaps in  Kenya’s AML/CFT regime;

(j)         undertake a technical needs assessment and identify potential providers of technical assistance for consideration by the Government and provide guidance on the provision of technical assistance to the appropriate stakeholders;

(k)         facilitate the provision of support and training to MDAs and other stakeholders on the FATF/NRA requirements for purposes of ensuring efficiency and effectiveness in compliance and implementation; and

(a)        perform any other duty relating to the mandate of the Task Force as may be assigned by the Cabinet Secretary for the National Treasury and Planning.

In the performance of its duties, the Taskforce shall—

(a)        be responsible to the Cabinet Secretary for the National Treasury and Planning;

(b)        hold meetings in places and at times as Taskforce may consider necessary for the proper discharge of its functions;

(c)         co-opt any persons that it may consider necessary and expedient for the proper performance of its functions; and

(d)        have all the necessary powers for the expedient discharge of its mandate including the power to regulate its procedure.

The term of the Taskforce shall be one year from the date of commencement of this Gazette Notice or such other longer period as may be determined by the Cabinet Secretary of the National Treasury and Planning, through a Gazette Notice.

The Secretariat:

The Financial Reporting Centre and the Bank Supervision Department of the Central Bank of Kenya shall be joint Secretaries of the Taskforce and the Secretariat will be based at the Financial Reporting Centre.

The Secretariat shall be responsible to the Taskforce for—

(a)        providing appropriate background briefing;

(b)        disseminating any information deemed relevant;

(c)         undertaking research and liaising with the relevant Government Ministries, Departments, Agencies, Commissions, Independent Offices and any other institution in order to gather relevant information necessary for informing the Taskforce;

(d)        organizing consultative forums and meetings for purposes of ensuring that the Task Force delivers on its mandate; and

(e)         facilitating the provision of the necessary administrative support to the Taskforce.

The Taskforce shall submit to the Cabinet Secretary for the National Treasury and Planning—

(a)    a progress report every three months after commencement of the NRA exercise;

(b)    Kenya’s Draft National Risk Assessment by the 31st January, 2020;

(c)      final report by the 28th February, 2020; and

(d)    a       National      Strategy      on      Combating      Money Laundering/Terrorism Financing by the 31st March, 2020.

TASKFORCE ON THE TRANSITION AND TRANSFORMATION OF THE PUBLIC TRANSPORT SECTOR DURING THE IMPLEMENTATION OF THE MRTS WITHIN THE NAIROBI METROPOLITAN AREA

IT IS notified for the general information of the public that the Cabinet Secretary for Transport, Infrastructure, Housing, Urban Development and Public Works has appointed a taskforce consisting of—

1. The Terms of Reference shall be to—

(a)        execute a memorandum of understanding on all principles  of operating the BRT Line 2 corridor;

(b)        advise on the establishment of a BRT Line 2 operating company;

(c)         set the terms of the transport service contract between NaMATA and the BRT Line 2 operating company; and

(d)        prepare a transport service contract between NaMATA and BRT Line 2 operating company.

2. In the performance of its functions, the taskforce shall—

(a)        identify the target group of operators who are presently operating on the route of Phase 1 of BRT Line 2;

(b)        sensitise the members of the target group of operators on the BRT plans, the characteristics of BRT operations, and the required fleet;

(c)         prepare documentation on the negotiation process;

(d)        appoint negotiators;

(e)         centre negotiations on the following topics—

(i)      transport demand;

(ii)      contract period and contract extensions;

(iii)       services to be delivered by operators including a service plan for Phase 1 of BRT Line 2 setting out the route, stops, timetables and projected bus kilometres per year, and fleet requirements;

(iv)      the role of NaMATA, contract management and performance monitoring including measurable indicators for delivered bus kilometres, safety and service quality, and associated penalties for non- compliance;

(v)      financial arrangements including fleet ownership, financing and business models; service fees based on revenue sharing or payments per bus kilometre; and cashless ticketing and revenue management; and

(vi)      other arrangements including the setup of the BRT Line 2 operating company; license requirements to use the BRT Lane; other license requirements; employment conditions; and insurance;

(f)         adverse impacts on investments and employment, and mitigation measures;

(g)        all details of the transport services contract for the operation of Phase 1 of BRT Line 2; and

(h)        any other matter necessary for the operationalisation of BRT Line 2.

3. In the performance of its functions, the taskforce may—

(a)        co-opt not more than three persons who possess the relevant expertise, skills and experience which it considers necessary and proper to achieve its objectives;

(b)        carry or commission such studies or research as may inform its recommendations to the Cabinet Secretary;

(c)         solicit, receive and consider views from members of the public and other interested parties; and

(d)        conduct any other activities required for the effective discharge of its mandate.

4. In the performance of its functions, the taskforce shall regulate its own procedure.

5. The taskforce shall remain in office for a period of one year with effect from the 3rd October, 2018 or for such longer period as the Cabinet Secretary may, by notice in the Gazette, prescribe.

6. The task force shall—

(a)        prepare and submit to the Cabinet Secretary reports of its progress at least once in each month;

(b)        propose preliminary recommendations to the Cabinet Secretary not later than two (2) months from the date of publication of this notice; and

(f)        develop Office of the Director Public Prosecutions charge sheet formats and information.

  1. In the performance of its mandate, the taskforce may, as the need arises, co-opt not more than two other members to advise or offer assistance on any area the task force may consider necessary.
  2. The taskforce shall prepare and submit its report to the Director of Public Prosecutions together with its recommendations within ninety (90) days from the date if its appointment.

THE LEADERSHIP AND INTEGRITY ACT (No. 19 of 2012)

THE LEADERSHIP AND INTEGRITY CODE OF CONDUCT FOR STATE OFFICERS IN THE COUNTY EXECUTIVE OF MANDERA

PURSUANT to section 37 of the Leadership and Integrity Act, 2012, the County Executive of Mandera establishes this Leadership and Integrity Code to be observed by and binding upon State Officers in the County Executive.

PART I—STATEMENT OF INTENT

A Leadership and Integrity Code for State Officers in the County Executive of Mandera made pursuant to the provisions of section 37 of the Leadership and Integrity Act, 2012 and to give effect to Chapter Six of the Constitution of Kenya. The Code is intended to establish standards of integrity and ethical conduct in the leadership and management of public affairs of the County Executive by ensuring that the State Officers respect the values, principles and provisions of the Constitution and other applicable laws or policies on the standards of conduct and performance expected of holders of public office in the discharge of their duties.

PART II—PRELIMINARY PROVISIONS

Citation

1. This Code may be cited as the Leadership and Integrity Code for State Officers in the County Executive of Mandera.

Commencement

2. This Code shall come into operation within seven days of its publication in the Kenya Gazette.

Interpretation

3. In this Code, unless the context otherwise requires— “Act” means the Leadership and Integrity Act, 2012;

“Accounting Officer” means the County Secretary of the County Government;

“Authorized Officer” means the Governor of the County of Mandera and includes his/her designate;

“Bank Account” has the meaning assigned to it under section 2 of the Act;

“Code” means the Leadership and Integrity Code for State Officers in the County Executive of Mandera

“Commission” means the Ethics and Anti-Corruption Commission established under section 3 of the Ethics and Anti-Corruption Commission Act, No. 22 of 2011;

“Gazette” means the Kenya Gazette; “His” includes the expression “her”;

“Office” means the office of the County Executive of Mandera;

“Personal Interest” means a matter in which a State Officer has a direct or indirect pecuniary or non-pecuniary interest and includes the interest of his or her spouse, child, business associate or agent;

“Public Officer” has the meaning assigned to it under Article 260 of the Constitution;

“Regulations” means the Regulations made by the Ethics and Anti- Corruption Commission pursuant to section 54 of the Act;

“Serving State Officer” means a State Officer who is in office at the time of commencement of this Code;

“State Officer” means a Member of the County Executive of Mandera;

Application of Chapter Six of the Constitution, the Leadership and Integrity Act, 2012 and the Public Officer Ethics Act, 2003

4. (1) The provisions of Chapter Six of the Constitution, the Leadership and Integrity Act, the Public Officer Ethics Act, 2003 and shall form part of the Code.

(2) In the event that any provision of this code is inconsistent with the general Leadership and Integrity Code prescribed under part II of the Leadership and Integrity Act, 2012 or provision of any other written law, the latter shall prevail.

Commitment to the Code

5. (1) A State Officer appointed to the County Executive shall sign and commit to this Code at the time of taking oath of office or within seven (7) days of assuming office.

(2)     A serving State Officer shall sign and commit to this Code within seven (7) days of the publication of the Code in the Gazette.

(3)    The declaration of commitment to the Code shall take the form and structure set out in the First Schedule to this Code.

PART III—REQUIREMENTS

Rule of Law

6.  (1) A State Officer shall respect and abide by the Constitution and all other laws.

(2)      A State Officer shall carry out the duties of his or her office in accordance with the law.

(3)     In carrying out the duties of his or her office, a State Officer shall not violate the rights and fundamental freedoms of any person.

Public Trust

7. A State Office is a position of public trust and the authority and responsibility vested in a State Officer shall be exercised by the State Officer in the best interest of the office and the people of Kenya.

Responsibility and Duties

8. Subject to the Constitution and any other law, a State Officer shall take personal responsibility for the reasonably foreseeable consequences of any actions or omissions arising from the discharge of the duties of his or her office.

Citizenship

9. (1) Subject to Article 78 (3) of the Constitution, a State Officer who acquires dual citizenship shall lose his or her position as a State Officer.

(2) A person who holds dual citizenship shall, upon election or appointment to a State Office, not take office before officially renouncing their citizenship in accordance with the provisions of the Kenya Citizenship and Immigration Act, 2011.

Performance of Duties

10. A State Officer shall, to the best of his or her ability—

(a)    carry out the duties of the office efficiently and honestly;

(b)    carry out the duties of the office in a transparent and accountable manner;

(c)     keep accurate records and documents relating to the functions of the office; and

(d)    report truthfully on all matters of the office.

Professionalism

11. A State Officer shall—

(a)    carry out the duties of his or her office in a manner that maintains Public confidence in the integrity of the office

(b)    treat members of the public, staff and other state and public officers with courtesy and respect;

(c)     to the extent appropriate to the office, maintain high standards of performance and level of professionalism within the office; and

(d)    if the State Officer is a member of a professional body, observe and subscribe to the ethical and professional requirements of that body in so far as the requirements do not contravene the Constitution, any other law or this Code.

Confidentiality

12. A State Officer shall subject to Article 35 of the Constitution and any other relevant law, a State Officer shall not disclose or cause to be disclosed any information in his or her custody to any unauthorized person.

Financial Integrity

13. (1) A State Officer shall not use his or her office too unlawfully or wrongfully enrich himself or herself or any other person.

(2)    Subject to Article 76 (2) (b) of the Constitution, a State Officer shall not accept a personal loan or benefit which may compromise the State Officer in carrying out his or her duties.

(3)     A State Officer shall submit an initial declaration of income, assets and liabilities within thirty (30) days of assuming office and thereafter make biennial declarations to the office, and a final declaration within (30) days of ceasing to be a State Officer.

(4)     A declaration filed by a State Officer in accordance with the provisions of sub-paragraph (3) shall be accessible to the Commission and any other person, subject to the provisions of section 30 of the Public Officer Ethics Act, 2003.

(5)     A State Officer shall pay any taxes, loans or other debts due from him within the prescribed period.

(6)      A State Officer shall not neglect their financial or legal obligations.

Moral and Ethical Requirements

14. (1) A State Officer shall observe and maintain the following ethical and moral requirements—

(a)   demonstrate honesty in the conduct of his or her public and private affairs;

(b)   not to engage in activities that amount to abuse of office;

(c)    accurately and honesty represent information to the public;

(d)   not engage in wrongful conduct in furtherance of personal benefit;

(e)    not misuse public resources;

(f)    not falsify any records;

(g)   not sexually harass or have inappropriate sexual relations with other State Officers, staff of the office or any other person;

(a)   not engage in actions which would lead to the State Officers removal from the membership of a professional body in accordance with the law;

(b)   not commit offences and in particular, any of the offences under parts XV and XVI of the Penal Code, Sexual Offences Act, 2006, the Counter- Trafficking in Persons Act, 2008, and the Children’s Act;

(c)    not engage in fighting or physical confrontation with any person; and

(d)   maintain high standards of etiquette at all times.

(2)    A person who wishes to be appointed to the Office shall for the purposes of this Code, submit to the Commission a self-declaration in the form set out in the First Schedule to the Act

(3)    In respect to a person wishing to be elected to the office, the declaration under sub-paragraph (2) shall be submitted to the Independent Electoral and Boundaries Commission.

(4)    A State Officer shall maintain high standards of etiquette at all times.

Gifts or Benefits in Kind

15. (1) A gift or donation given to a State Officer on a public or official occasion shall be treated as a gift of donation to the office.

(2)       Notwithstanding subparagraph (1), a State Officer may receive a gift given to the State Officer in official capacity, provided that—

(a)    the gift is within the ordinary bounds of propriety, a usual expression of courtesy or protocol and within the ordinary standards of hospitality;

(b)    the gift is not monetary; or

(c)     the gift does not exceed the value of Kenya Shillings twenty thousand or such other amount as may be prescribed by the Commission through regulations.

(3)    A State Officer shall not—

(a)    Accept or solicit gifts, hospitality or other benefits from a person who—

(i)         has an interest in any matter under consideration by the Assembly;

(ii)        has a contractual relationship with the office; or

(iii)       has any interest that is directly or indirectly connected with the State Officers duties;

(b)    receive a gift which has the potential of compromising his or her integrity, objectivity or impartiality; or

(c)     accept any type of gift expressly prohibited under the Act.

(4)    A State Officer who receives a gift or donation shall declare the gift or donation to the Authorized Officer within seven (7) days of receipt of the gift.

(5)    The Office shall maintain a register of all gifts received by the state Officers serving in the Office and another register of all gifts given by the office to other State or Public Officers.

Wrongful or Unlawful Acquisition of Property

16. A State Officer shall not use the office to wrongfully or unlawfully acquire or influence the acquisition of public or other property.

Conflict of Interest

17. (1) A State Officer shall use the best efforts to avoid being in a conflict of interest a situation where his or her personal interests conflict or appear to conflict with the State Officer’s official duties.

(2)     Without limiting the generality of subparagraph (1), a State Officer shall not hold shares or have any other interest in a  corporation, partnership or other body, directly or through another person, if holding those shares or having that interest would result in a conflict of the State Officers and the officers official duties.

(2)        A State Officer whose personal interest’s conflict with their official duties shall declare the personal interest to the office.

(3)        The Office may give directions on the appropriate action to the taken by the State Officer to avoid the conflict of interest and the State Officer shall comply with the directions, and refrain from participating in any deliberations with respect to the matter.

(4)        Any direction issued by the office under sub paragraph (4) shall be in writing;

(5)        Notwithstanding any directions to the contrary under subparagraph (4), a State Officer shall not influence the award of a contract to—

(a)    himself or herself;

(b)    the State Officers spouse or child;

(c)     a business associate or agent; or

(d)    a corporation, private company, partnership or other body in which the officer has a substantial or controlling interest.

(6)        Where a State Officer is present at a meeting, and an issue which is likely to result in a conflict of interest is to be discussed, the State Officer shall declare the interest at the beginning of the meeting or before the issue is deliberated upon.

(7)        A declaration of a conflict of interest under subparagraph (7) shall be recorded in the minutes of that meeting.

(8)        The Office shall maintain a register of conflicts of interest in the prescribed form in which an affected State Officer shall register the particulars of the registrable interests, stating the nature and extent of the conflict.

(9)        For purposes of subparagraph (9), the registrable interests shall include—

(a)    the interests set out in the second schedule of the Act;

(b)    any connection with a person, firm or a company, whether by relation, friendship, holding of shares or otherwise, which is subject of an investigation by the Constitution;

(c)     any application for employment or other form of engagement with the office by a family member or friend of the State Officer or by a law firm or corporation associated with the State Officer;

(d)    any application to the office, by a family member or friend of the State Officer, for clearance with respect to appointment  or election to any public office; and

(e)     any other matter which, in the opinion of the State Officer, taking into account the circumstances thereof, is necessary for registration as a conflict of interest.

(10)      The Office shall keep the register of conflicts of interest for five years after the last entry in each volume of the register.

(11)      The Office shall prepare a report of the registered interests within thirty (30) days after the close of a financial year.

(12)      A State Officer shall ensure that an entry of registrable interests under subparagraph (9) is updated and to notify the office of any changes in the registrable interests, within one (1) month of each change occurring.

Participation in Tenders invited by the Office

18. (1) A State Officer shall not participate in a tender for the supply of goods or services to the office.

(2)      Notwithstanding subparagraph (1), a company or entity associated with the State Officer shall not be construed as trading with the office, unless—

(a)    the State Officer has a controlling shareholding in the company or entity or;

(b)    the State Officer is a director of the company; or

(c)     the State Officer is a managing partner in a law firm providing services to the office.

Public Collections

19. (1) A State Officer shall not solicit for contributions from the office or any other person or, public entity for a public purpose unless the President has, by notice in the Gazette, declared a national disaster and allowed a public collection for the purpose of the national disaster in accordance with the law.

(2)     A State Officer shall not participate in a public collection of funds in a way that reflects adversely on the State Officers’ integrity, impartiality or interferes with the performance of the official duties.

(3)    Nothing in this clause shall be construed as prohibiting a State Officer from making voluntary contribution.

Bank Accounts outside Kenya

20. (1) Subject to Article 76 (2) of the Constitution or any other written law, a State Officer shall not open or continue to operate a bank account outside Kenya without the approval of the Commission.

(2)     A State Officer who has reasonable grounds for opening or operating a bank account outside Kenya shall apply to the commission for approval to open or operate a bank account outside Kenya.

(3)     A State Officer who operates or controls the operation of a bank account outside Kenya shall submit statements of the account annually to the commission and authorize the commission to verify the statements and any other relevant information from the foreign financial institution in which the account is held.

(4)    Subject to subparagraph (1) and (2), a person who is appointed as a State Officer in the office and has a bank account outside Kenya shall, upon such appointment close the bank account within three (3) months or such other period as the Commission may prescribe by notice in the Gazette.

(5)     Subject to subparagraph (4), a State Officer may open or continue to operate a bank account outside Kenya as may be authorized by the Commission in writing.

Acting for Foreigners

21. (1) A State Officer shall not be an agent of, or further the interests of a foreign government, organization or individual in a manner that may be detrimental to the security interests of Kenya, except when acting in the course of official duty.

(2)    For the purposes of this paragraph—

(a)    an individual is a foreigner if the individual is not a citizen of Kenya; and

(b)    an organization is foreign if it is established outside Kenya or  is owned or controlled by a foreign government, organization or individual

Care of Property

22. (1) A State Officer shall take all reasonable steps to ensure that public property in his or her custody, possession or control is taken care of and is in good repair and condition.

(2)    A State Officer shall not use public property, funds or services that are acquired in the course of or as a result of the official duties, for private activities of activities that are not related to the official work of the State Officer.

(3)    A State Officer shall return to the office all the public property in his or her custody, possession or control at the end of the election or contract term.

(2)    A State Officer who contravenes subparagraph (2) or (3) shall, in addition to any other penalties provided for under the Constitution, the Act or any other law, be personally liable for any loss or damage to the public property.

Misuse of Official Information

23. (1) A State Officer shall not directly or indirectly use or allow any person under the officers authority to use any information obtained through or in connection with the office, which is not available in the public domain, for the furthering of any private interest, whether financial or otherwise.

(2)     A State Officer shall not be deemed to have violated the requirements of subparagraph (1), if the information given—

(a)    pursuant to a court order

(b)    for purposes of educational, research, literary, scientific or other purposes not prohibited by law; or

(c)     in compliance with Article 35 of the Constitution and the relevant law.

Impartiality

24. A State Officer shall, at all times, carry out the duties of the Office with impartiality and objectivity in accordance with principles and values set out in Articles 10, 27, 73 (2) (b) and 232 of the Constitution and shall not practice favouritism, nepotism, tribalism, cronyism, religious bias or engage in other preferential treatment of another State Officer, Public Officer or a member of the public.

Giving of Advice

25. A State Officer who has a duty to give advice shall give honest, accurate and impartial advice without fear or favour.

Offers of Future Employment

26. (1) A State Officer shall not allow himself of herself to be influenced in the performance of his or her duties by plans or expectations for or offers of future employment or benefits.

(2) A State Officer shall disclose, in writing, to the Commission, all offers of future employment or benefits that could place the State Officer in a situation of conflict of interest.

Former State Officer acting in a Government or Public Office

27. A former State Officer shall not be engaged by the Office in a matter in which the State Officer was originally engaged in as a State Officer, for at least two (2) years after leaving the office.

Misleading the Public

28. A State Officer shall not knowingly give false or misleading information to any person.

Falsification of Records

29. A State Officer shall not falsify any records or misrepresent information to the public.

Conduct of Private Affairs

30. A State Officer shall conduct their private affairs in a manner that maintains public confidence in the integrity of the Office.

Bullying

31. (1) A State Officer shall not bully another State or Public Officer or any other person.

(2) For purposes of subparagraph (1), “bullying” includes blackmail, coercion, threats, intimidation or repeated offensive behaviour which is vindictive, cruel, malicious or humiliating whether or not is intended to undermine a person and includes physical assault

Acting through Others

32. (1) A State Officer shall not—

(a)    cause anything to be done through another person that would constitute a contravention of this Code, the Constitution or any other law if done by the State Officer; or

(b)    allow or direct a person under their supervision or control to do anything that is in contravention of this Code, the Constitution or any other law.

(2) Subparagraph (1) (b) shall not apply where anything is done without the State Officer’s knowledge or consent or if the State Officer has taken reasonable steps to prevent it.

Reporting Improper Orders

33.(1) If a State Officer considers that anything required of him or she is in contravention of the Code or is otherwise improper or unethical, the State Officer shall report the matter to the Commission.

(2) The Commission shall investigate the report and take appropriate action within ninety (90) days of receiving the report.

Duty to Prevent Occurrence of Corruption or Unethical Practice in the Office

34. A State Officer who believes or has reason to believe corrupt act or unethical malpractice has occurred or is about to occur in the office shall take all necessary measures to prevent it from continuing or materializing in addition to any other appropriate action.

Use of Social Media

35. A State Officer shall not use social media in a manner that is prejudicial to public interest, national cohesion or that otherwise constitutes a breach of any law.

Dress Code

36. A State Officer shall maintain appropriate standard of dress and personal hygiene at all times.

Political and other Influence

37. (1) A State Officer shall exercise independence in the discharge of his duties and shall not allow himself to be subjected to political or any other internal or external influence that is detrimental to public interest

(2)    A State Officer shall not influence of attempt to influence the decision of any other State or Public Officer or public entity on any matter.

(3)    A State Officer shall not in any way interfere with the duties of any other State Officer Public Officer or public entity.

Implementation of Development Projects

38. (1) A State Officer shall exercise prudence in the undertaking of development projects and shall at times prioritize projects that are most urgent for the public.

(2)     For the purposes of sub-paragraph (1), a State Officer shall, before planning for any project, to the extent applicable, undertake and facilitate public and stakeholder participation in the determination of the projects to be implemented at any given time.

(3)     A State Officer shall not undertake any project without prior planning or budgeting.

(4)    A State Officer shall not demand or accept any kickbacks, gifts, benefits or other favours from contractors.

(5)      A State Officer shall not compromise or abet compromising of standards of any project implemented for the Office.

(6)     A State Officer shall, subject to the law, disclose all relevant information regarding any project to any person requiring such information

Preferential Treatment

39. A State Officer shall ensure equal and equitqble distribution of resources to all persons and any section of the population in his area of jurisdiction and shall not confer any undue advantage to any person or section of the population.

PART IV—ENFORCEMENT OF THE CODE

40. (1) Any person may lodge a complaint alleging a breach of this code by a State Officer to the Office or to the Commission.

(2)    Breach of this Code amounts to misconduct for which the State Officer may be subjected to disciplinary proceedings including removal from office.

(3)      Where a breach of this code amounts to violation of the Constitution, the State Officer may be removed from the office in accordance with the applicable laws.

(4)    Where an allegation of breach is made to the Office, the person alleging the breach shall submit a petition setting out the grounds and facts of the alleged violation to the Authorized Officer of the Office.

(5)     Upon receipt of the complaint, the Office shall register and carry out investigations into the complaint, and may take action  against the State Officer in accordance with the Act and any regulations made by the Commission under the Act.

(6)     If upon investigation into the alleged breach of the Code, the Office is of the opinion that civil or criminal proceedings ought to be

preferred against the respective State Officer, it shall refer the matter to—

(a)      the Commission, with respect to civil matters; and

(b)      the Director of Public Prosecutions with respect to criminal matters.

(3)      Where the complaint is made to the Commission, the Commission shall take such action against the State Officer as  it deems necessary in accordance with its mandate under the law

(4)      Notwithstanding sub-paragraph (5), the Commission may, subject to the law, take any additional action it deems appropriate in relation to any breach of the Code or require the Office to take any action against a State Officer who has breached the Code.

Victimization

41 A State Officer shall not in any way victimize any other State Officer or Public Officer or any other person for any lawful action or omission.

Duty of Authorized Officer and Accounting Officer to Comply with Directives of the Commission in Implementation of the Code

42. The Authorized Officer or Accounting Officer of the Office shall at all times comply with such orders or directives as may be issued by the Commission from time to time towards the implementation and enforcement of this Code.

PART IV—GENERAL PROVISIONS

Advisory Opinion

43. A State Officer or the office may request the Commission to give an advisory opinion on any issue relating to, but not limited to—

(a)        the application of Chapter Six of the Constitution;

(b)        the application of the Act or any other applicable law or regulations dealing with the ethics and integrity of State Officers;

(c)         the application of the Public Officer Ethics Act, 2003, or any other law or regulations dealing with the ethics and integrity of public officers;

(d)        the application of this Code;

(e)         an ethical dilemma; or

(f)         any other matter incidental to the promotion of the ethics and integrity of State Officers and public officers generally.

Training on Leadership and Integrity

44. The office shall collaborate with the Commission to ensure that the State Officers and public officers serving in the Office are sensitized on leadership and integrity issues at least once a year.

Personal Responsibility for Compliance

45. Each State Officer shall take personal responsibility or compliance with the provisions of this Code.

Annual Report

46. The Authorized Office or his designate shall cause to be prepared and submitted to the Commission an Annual Report on the progress made in implementation and enforcement of the Code in a prescribed format by the Commission.

Amendment of the Code

47. The Office may with approval of the Commission amend this Code.

Copies of the part development plans as prepared have been deposited for public inspection at Mariakani, Mtwapa and Kaloleni Town/Sub-County Administrators Offices, respectively and at the County Physical Planning Office, Kilifi.

The copies so deposited are available for inspection free of charge by all persons interested at Mariakani, Mtwapa and Kaloleni Town/Sub-County Administrators Offices, respectively and at the County Physical Planning Office, Kilifi, between 8.00 a.m. to 1.00

a.m.     and 2.00 p.m. to 5.00 p.m., Monday to Friday.

THE NATIONAL ENVIRONMENT MANAGEMENT AUTHORITY

ENVIRONMENTAL IMPACT ASSESSMENT STUDY REPORT FOR THE PROPOSED RESIDENTIAL APARTMENTS DEVELOPMENT ON PLOT L.R. NO. 209/3289 OFF OLOITOKTOK ROAD, ALONG KANGUNDO ROAD IN KILELESHWA AREA, WESTLANDS SUB-COUNTY, NAIROBI CITY COUNTY

INVITATION OF PUBLIC COMMENTS

Pursuant to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The proponent, Tian Yu International Company Limited, is proposing to construct four blocks (A, B, C and D) of fourteen (14) leveled residential apartment building comprising a total of two hundred and ten (210) units. The ground floor (upper and lower  ground floor) will consist of 3No. 210 basement parking, 2No. generator rooms, 8No. lobby areas, 2No. garbage collection points and drive-way. Block A will comprise of 98No. one bedroom units (7No. units on each floor), Block B will comprise of 56No. two bedroom units (4No. units on each floor), and Block C and D will comprise of 56No. two bedroom units on each block (2No. units on each floor) and other associated facilities and amenities on plot L.R. No. 209/3289 off Oloitoktok Road, along Kangundo road in Kileleshwa area, Westlands Sub-County in Nairobi City County.

The following are the anticipated impacts and proposed mitigation measures:

Exploitation of raw materials

  • The contractor will obtain raw materials for the construction from sources that are compliant with NEMA Regulations.

Impacts            Proposed Mitigation Measures

  • The contractor will procure quantities that are sufficient for the intended works only and recycle as far as practical to curtail wastage.
  • The contractor will commit to extensive use of recycled raw materials as will be appropriate and in a manner that does not compromise the safety of the development.

Effluent discharge

  • The waste water from the premises will be connected to the existing sewer line that serves the area.
  • Conduct regular inspections for waste water pipe blockages or damages and fix appropriately.
  • Ensure regular monitoring of waste water discharged from the project to ensure that the stipulated sewage/effluent discharge rules and standards are not violated.
  • All drain pipes passing under the building, driveway or parking should be of heavy duty PVC pipe tube encased in 150mm concrete all round.
  • All manholes on driveways and parking areas should have heavy duty covers set and sealed airtight as approved by specialists.
  • All waste pipes should be accessible from outside and free to every part of the system for inspection, cleaning and repair.

Increased water demand

  • Installation of flush toilets with low volume cisterns and high pressure.
  • Waste water recycling and rain water harvesting.
  • Immediate repair of water pipe and tank leaks.
  • Install water conserving taps that turn-off automatically when water is not being used.
  • Ensure taps are not running when not in use.

Noise and excessive vibrations

  • Workers working with machinery, vehicles and instruments that emit high levels of noise should be provided with ear plugs and ear muffs.
  • Proper servicing of machinery and equipment (oiling, greasing etc.).
  • Installation of portable barriers to shield compressors and other small stationary equipment where necessary.
  • Construction activities to be carried out between 8.00 a.m. –5.00 p.m.
  • Monitor noise levels as per NEMA guidelines

Solid waste generation

  • Order materials in the sizes and quantities they will be needed.
  • Use excavated soil for backfilling and landscaping.
  • Use solid waste management system  i.e. through a hierarchy of options: source  reduction; recycling; composting and reuse; combustion; sanitary land filling.
  • Provide facilities for proper handling and storage of construction materials to reduce the amount of waste caused by damage or exposure to the elements.
  • Reuse materials such as cartons, cement bags, steel metals, and plastic containers to reduce waste.
  • Dispose the excess excavated soil and any other waste by use of a licensed waste hauling company.

Impacts             Proposed Mitigation Measures

Increased energy use

  • Switch off electrical equipment, appliances and lights when not in use.
  • Install occupation sensing lighting at various locations such as storage areas which are not in use all the time.
  • Tap solar energy for heating and lighting purposes.
  • Install energy saving at all lighting bulbs.
  • Monitor energy use during the operation of the project and set targets for efficient energy use.
  • Sensitize residents in use of energy efficiently.

Air pollution   

  • Spray water on exposed  areas  during  dry weather to suppress dust.
  • Cover loads of friable materials during transportation.
  • Building under construction to be covered with adequate screens to contain dust particles.
  • Stock piles to be covered with tarpaulins.
  • Control speed of construction vehicles and switch off machines when not in use.
  • Regularly service and maintain vehicles and mobile plants and machinery.
  • Provide personal protection equipment to workers.

Occupational health and safety

  • Provide adequate well stocked first aid boxesacross the site and adequately train all staff on basic first aid administration.
  • Adequate warning/inductions and instruction signs must be prominently displayed on the project site.
  • Ensure that workers at the site are adequately protected through provision of suitable personal protective gears.
  • Limit public access to the construction site.
  • Ensure that all construction machines/ equipment are operated by experienced personnel and regularly serviced in order to avoid any accidents.

Fire hazards     

  •   Installation of an automatic fire alarm system for the building.
  • Provision of firefighting equipment and hydrant points.
  • Display fire excavation procedures and emergency at strategic points in the building.
  • Regular maintenance of fire electrical and first aid equipment.
  • Provision of emergency exit and fire assembly points.

Pursuant to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The proponent, Kenya Electricity Transmission Company Limited, is proposing to build a 53 Km, 220kV transmission Line (TL) from Mariakani–Dongo Kundu to supply electricity to the Mombasa Special Economic Zone (Mombasa SEZ) to be built in Dongo Kundu, Mtongwe Location, Likoni Sub-County in Mombasa County. The project will comprise: development of 220 kV overhead double circuit transmission line supported by steel-lattice type transmission towers from Mariakani 400/220 kV Substation to Mombasa SEZ; development of 220/33 kV substation inside Mombasa SEZ, the substation will mainly consist of transformers (75 MVA x 2 units), control building and access road; and development of 33 kV overhead double circuit distribution line (supported by concrete pole/foundation) inside Mombasa SEZ from 220/33 kV substation.

The following are the anticipated impacts and proposed mitigation measures:

Environmental degradation

  • Regular inspection of vehicles and machines for oil and fuel leaks. Leaking vehicles and machines to be removed until repaired.
  • Maintenance activities to be conducted at designated facilities with appropriate pollution control.
  • Spill response kit to be readily available at the construction site.
  • Fuel tanks to be installed on an impermeable base with bunds.

Air pollution           

  • Implement regular maintenance and vehicles emitting visible pollutants.
  • Construction vehicles without inspection certificate will not be allowed to operate.
  • Slow driving on dusty roads within the community area.
  • Regular water spraying of access road.
  • Cover truck loading bed when transporting loose materials such as rock, sand and mud.
  • Avoid to the extent possible passing through sensitive areas.

Noise and excessive vibrations

  • Equipping vehicles and machinery with exhaust mufflers and carry out proper maintenance.
  • Instructing truck and machinery operators to avoid raving of engines.
  • Avoiding as much as possible use of roads that pass through sensitive areas.
  • Avoiding as much as possible the conducting of noisy works during night time.
  • Locate towers at least over distance of 25 m from the nearest structure.

Safety and health risks to personnel

  • Use of safety harness during working at height.
  • Install barriers around excavated pits.
  • Engage only qualified operators.
  • Use of PPE.
  • Construction contractor to prepare an Occupational Health and Safety Plan in accordance to Kenyan laws and regulations.

Water pollution       

  • Exposed cut and fill slopes at the substation/access road to be protected as soon cut and fill works are completed.
  • Install temporary erosion control measures as necessary.
  • Stockpiles to be covered by sheet.
  • Temporary construction yard to be located as far as possible from surface water bodies and wetlands.

Waste                       

  • Minimize waste generation through reuse and recycling.
  • Use transformer oil free of PCBs.
  • Wastes to be handled and disposed only by NEMA authorized firms.
  • Waste disposal containers to be provided onsite for each waste category.
  • Oil pit to be regularly emptied and kept in containers for disposal by NEMA approved firms.
  • Preparation of Waste Management Plan (WMP) that identifies the different wastes that will be generated and their proposed disposal procedure

Conservation area    

  • Before commencement of construction,hold meetings with Kaya elders to inform about the construction schedule  and works, and consult for necessary mitigation measures.
  • Prohibit entrance of construction workers inside the Kaya.
  • Establish temporary construction yard as far as possible from the Kaya
  • Use as far as practical low-noise construction machines.

INVITATION OF PUBLIC COMMENTS

Pursuant to Regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The proponent, Advanced Molecular Imaging Limited, is proposing to refurbish and equip an existing godown (go down no. 9) with medical cyclotron facility equipment and tools. The project will comprise; the ground floor will comprise loading/ unloading area, dispatch area, storage area, packing, hot lab, gowning room, clan room and waste material room, Q.C. lab, cyclotron area; there also will be parking spaces; the first floor will comprise offices, meeting room, training centre and pantry, and associated amenities and facilities.

The following are the anticipated impacts and proposed mitigation measures:

Noise pollution

  • Ensure that all vehicles and construction machinery are kept in good condition all the time to avoid excessive noise generation.
  • Ensure that all workers wear ear muffs and  other personal protective gear/equipment when working in noisy sections.
  • Undertake loud noise and vibration level activities during off-peak hours during the day (i.e. preferably between 12.00 noon and 2.00 p.m.).
  • Comply with conditions provided by the Environment Management and Co-ordination, Noise and Excessive Vibrations Pollution Control Regulations, 2009.

Air pollution

  •  Maintenance of plant and equipment and sensitize workforce.
  • Turn off vehicle engines when idle.
  • Operations to be done during the day only.

Solid waste management

  • Workers to be encouraged to segregate waste from the source, use the 3R Management Approach: Reduce, Reuse and Recycle.
  • Limit waste quantity by proper planning.
  • Godowns management to be carrying out inspections within and around the building.
  • Godowns management staff to have a functional waste management system.
  • Waste disposal bins to be placed in all departments in the godowns.
  • Comply with provisions of the Environmental Management and Co-ordination, Waste Management Regulations, 2006.

Radiological Safety

  • Workers to wear radiation badge while in the building only.
  • Workers should not bring food, drinks, makeup or their packaging in the working area, especially cyclotron room.

Cyclotron room and possible exhausts

  • Ventilation and air changes shall be inaccordance with DIN 6844, Pt 1.
  • The cyclotron room pressure shall be  maintained at negative pressure relative to the surrounding areas.
  • All exhaust from cyclotron and chemistry enclosures must pass through a proper filtration.
  • Monitoring system to meet national and local safety code requirements.
  • Specified temperature and humidity levels are maintained during daily operation.

Fire

  •  Hoses and fire extinguishers are checked and maintained on schedule for continued operability.
  • Necessary fire related training.
  • Implement monitoring programs, parameters and procedures for control and corrective actions in case of emergencies, e.g. fire and workplace accidents.
  • Fire training sessions for all employees are carried out, with practical demonstrations on how to combat fire.

Occupational health and safety

  • Provide and enforce use of appropriate protective gear, -dust masks, protective shoes etc.
  • The godowns construction site to be out of bounds to unauthorized intruders, food vendors or job seekers.
  • Develop liaison with health provision arms for emergency response.
  • Provide security services within the godowns.
  • All firefighting equipment to be constantly inspected by authorized agents for continual operability.
  • Staff of the godowns to have at least one trained First Aider, aware of firefighting techniques, precautions etc.

IMPORTANT NOTICE TO SUBSCRIBERS TO THE KENYA GAZETTE

THE following notes are for the guidance of persons submitting “copy” for inclusion in the Kenya Gazette, Supplement, etc.:

(1)        The Kenya Gazette contains Notices of a general nature which do not affect legislation. They are, therefore, submitted to the Government Printer directly.

(2)        Legislative Supplement contains Rules and Regulations which are issued by the Central Government. Because of this, they must be submitted to the Government Printer through the office of the Attorney-General.

(3)        Bill Supplement contains Bills which are for introduction in the National Assembly.

(4)        Act Supplement contains Acts passed by the National Assembly.

All “copy” submitted for publication should be prepared on one side of an A4 sheet no matter how small the Notice is, each page being numbered and should be typewritten with double spacing. Copy should be clear, legible and contain no alterations.

Particular attention should be paid to the following points:

(i)         Signature must be supported by rubber-stamping or typing the name of the signatory in capital letters.

(ii)        Must be correct and filled in where necessary.

(iii)       Care should be taken to ensure that all headings to Notices and references to legislation are up to date and conform with the Revised Edition of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION D—

“D 34. (1) Communications for the Kenya Gazette should reach the Government Printer not later than 9 a.m. on Friday of the week before publication is desired. The Government Printer will not publish communications received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested that persons submitting copy for publication first satisfy themselves that such copy is complete in every respect.
