APPOINTMENT

IT IS notified for the general information of the public that the Cabinet Secretary for Information, Communication and Technology has appointed a Taskforce for the exploration and analysis of upcoming digital technologies that demonstrate great potential to transform Kenya’s economy including disruptive technologies that are currently shaping the global economy such as distributed ledger technologies (blockchain and hashgraph), artificial intelligence (A.I.), 5G wireless technology, and the internet of things. The Taskforce shall comprise of—

  1. The terms of reference of the Taskforce shall be to—

(a) to critically review distributed ledgers and artificial intelligence technologies;

(b) to contextualize how the application of distributed ledgers and artificial intelligence technologies can and will deliver the Government’s Big Four Agenda of affordable housing, universal healthcare, manufacturing and agriculture agro-processing;

(a) to develop a roadmap on how distributed ledgers and artificial intelligence technologies can promote and enhance Government services including—

(i)       overall public service delivery;

(ii)     job-creation through the Ajira Digital Programme;

(iii)    cybersecurity;

(iv)    single digital identity;

(v)     financial inclusion;

(vi)    reduction of transactional fraud;

(vii)  land titling;

(viii) democracy;

(ix)    election process; and

(x)     the sharing economy;

(b) to prepare an implementation strategy with key performance indicators and clear delivery timelines; and

(c)  to prepare and present a comprehensive report on all aspects of this assignment to the Cabinet Secretary.

  1. In the performance of its mandate, the Taskforce—

(a) shall hold such number of meetings in such places and at such times as the Taskforce shall, in consultation with the Cabinet Secretary, consider necessary for the proper discharge of its mandate;

(b) shall review official reports, policies, legislation or any document related to its mandate;

(c)  shall hold consultative meetings with sector stakeholders and members of the public;

(d) may carry out or cause to be carried out such studies or research as may inform the Taskforce on its mandate; and

(e)  may co-opt such other persons who possess the appropriate competencies as are necessary for the performance of its mandate.

  1. The term of office of the Taskforce shall be three months from the date of the publication of this notice.
  2. The Taskforce shall prepare and submit to the Cabinet Secretary a work plan and a progress report at the end of the third week after its appointment and its final report at the end of three (3) months after its appointment.
  3. The Taskforce shall regulate its own procedure.
  4. The Cabinet Secretary may appoint a secretariat to offer support services to the Taskforce.
  5. The Secretariat of the Taskforce shall be based at the headquarters of the Ministry of Information, Communication and Technology, 10th Floor, Boardroom, Telposta Towers, Kenyatta Avenue, Nairobi.

COMMITTEE ON THE NAIROBI CITY COUNTY GOVERNMENT PENDING BILLS

APPOINTMENT

IT IS notified for general public information that the Governor of the Nairobi City County, have established a committee to be known as the Committee on the Finalisation of Pending Bills and Audit of Procurement Processes. The purpose of the Committee is to bring to finality the problem of pending bills claimed against the County Government.

It is further notified for information that upon publication of this notice any person with any claim or pending bill against the erstwhile Nairobi City County should, within twenty-one (21) days of the publication of this notice, submit claims or bills to the committee for consideration.

This applies where such claims have been submitted prior to this notice or not.

The Committee shall consist of—

The Chairman and other members of the committee shall, prior to embarking on their duties, subscribe to the declaration prescribed in the Schedule.

The terms of reference of the committee shall be to:

(a) Scrutinize and analyse all existing stock of Nairobi City County Government pending bills, with a view to making appropriate recommendations to the County Treasury for payment or otherwise.

(b) Develop a clear procedure and criteria for dealing with existing County Government pending bills.

(c)  Identify cases where there may have been corrupt, fraudulent and false claims against the County Government and make appropriate recommendation to the relevant Government/State departments.

(d) Prepare a payment priority list of all cleared payments taking into account the need for equitable treatment of the creditors and of the cash-flow realities of the County Government.

(e)  Develop a system to ensure that future escalation of pending bills within the County Government is avoided, and

(f)   Perform any other function incidental to the foregoing.

In the performance of its functions the committee:

(a) shall hold such number of meetings at such places and such times as the committee shall consider necessary for the proper discharge of its mandate;

(b) may consult with the Governor on any matter within its mandate;

(c)  shall have access to reports of any previous investigations relevant to its mandate;

(d) shall, as it considers appropriate, carry out or cause to be carried out such studies or research as may inform the committee on its mandate;

(e)  may submit monthly progress reports to the Governor; and

(f)   subject to the foregoing, they shall have all the independence necessary for carrying out its function or expedient for the proper execution of its mandate, including the power to regulate its own procedure without being the subject of control by any other authority.

The Committee shall:

(a) Within (1) one month, after scrutiny and analysis of the County Government’s stock of pending bills, (or such longer period that the Governor may authorize) submit to the Governor a report recommending to the Treasury settlement or otherwise of the pending bills.

(b) Within (12) twelve months submit to the Governor a final report detailing a system geared towards ensuring that future escalation of pending bills within the County Government is avoided and on the streamlining of the procurement processes within the County Government.

(c)  Submit as appropriate, interim reports to the Governor as the committee may find fit and necessary or as the need arises and

(d) In consultation with the Governor, have the power to co-opt or to appoint committees as it deems fit only for specialized aspects of its terms of reference.

The Secretariat of the Committee: -

The Secretariat of the Committee shall be based at the City Hall and shall be responsible to the committee for—

(a) providing appropriate background briefing to the Committee;

(b) preparing the Committee’s reports and disseminating any information deemed relevant to the Committee; and

(c)  undertaking research and liaising with the relevant National and Nairobi City County Government Departments and any other institution in order to gather relevant information necessary for informing the Committee.

INQUIRY

IN PURSUANCE of section 112 and 162 (2) of the Land Act, 2012 and Gazette Notice Nos. 9589 of 2016 and 10870 of 2017, the National Land Commission gives notice that the Government intends to undertake inquiries for the following parcels of land on behalf of Athi Water Services Board for the construction of Raw and Treated Water Pipeline from Thika Dam to Kigoro Treatment Works to Gigiri Tanks in Muranga and Kiambu Counties for public purpose.

The Easter Recess of the High Court and Courts of Equal Status shall commence on 22nd March, 2018 and terminate on 3rd April, 2018, both days inclusive.

For avoidance of doubt, Recess Duty Judges shall be appointed to hear and try matters arising during recess in accordance with the High Court (Practice and Procedure) Rules as follows:

NOTICE is given that PowerGen Renewable Energy East Africa, a limited liability company having its registered office at Karen Plains Arcade, Nairobi in the Republic of Kenya, (“the applicant”), pursuant to the provisions of section 28 of the Energy Act, 2006, on 21st February, 2018, made an application to the Energy Regulatory Commission for the electric power for a permit for distribution and supply of electricity to selected customers on the Unilever tea estate in Kericho county.

The grant of the permit will not have adverse effect on any public or local authorities, companies, persons or bodies of persons within the areas of the undertaking.

INVITATION OF PUBLIC COMMENTS

PURSUANT to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The proponent, The Chiromo Lane Medical Centre, is proposing to decommission the current bungalow and erect a four-storey building (ground + 3 levels and attic level) that will house consultation rooms and an in/outpatient department on plot L. R. No. 3734/37 along Muthangari Road, Lavington, Nairobi City County.

The following are the anticipated impacts and proposed mitigation measures:

Occupational health and safety risks

  • Use of suitable personal protective equipment.
  • Use of stable ladders and other climbing/support structures.
  • Sensitize workers in construction safety measures.
  • Cleanliness and organization at the construction site.
  • Fencing or covering of risky areas such as deep pits.
  • Safety signage.
  • Engagement of skilled laborers.
  • Comply with the provisions of OSHA 2007.

IMPORTANT NOTICE TO SUBSCRIBERS TO THE KENYA GAZETTE

THE following notes are for the guidance of persons submitting “copy” for inclusion in the Kenya Gazette, Supplement, etc.:

(1)       The Kenya Gazette contains Notices of a general nature which do not affect legislation. They are, therefore, submitted to the Government Printer directly.

(2)       Legislative Supplement contains Rules and Regulations which are issued by the Central Government. Because of this, they must be submitted to the Government Printer through the office of the Attorney-General.

(3)       Bill Supplement contains Bills which are for introduction in the National Assembly.

(4)       Act Supplement contains Acts passed by the National Assembly.

All “copy” submitted for publication should be prepared on one side of an A4 sheet no matter how small the Notice is, each page being numbered and should be typewritten with double spacing. Copy should be clear, legible and contain no alterations.

Particular attention should be paid to the following points:

(i)        Signature must be supported by rubber-stamping or typing the name of the signatory in capital letters.

(ii)      Must be correct and filled in where necessary.

(iii)     Care should be taken to ensure that all headings to Notices and references to legislation are up to date and conform with the Revised Edition of the Laws of Kenya.

“D 34. (1) Communications for the Kenya Gazette should reach the Government Printer not later than 9 a.m. on Friday of the week before publication is desired. The Government Printer will not publish communications received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested that persons submitting copy for publication first satisfy themselves that such copy is complete in every respect.
