EXEMPTION

PURSUANT to the provisions of section 25(3) of the Competition Act, 2010, it is notified for general information of the public that Majid Al Futtaim Hypermarkets Limited (trading as Carrefour) (the lessee) and Two Rivers Lifestyle Centre Limited (the lessor) have made an application under section 25 (1) of the Act for the exemption of clause 7.4 of the proposed seven year lease agreement from the provisions of section A of Part III of the Act.

In clause 7.4 of the lease agreement the parties propose that the lessor shall not lease any part of the Centre to any hypermarket, supermarket, butcheries, green grocers or fruit or vegetable stores or permit the expansion of the leased premises without the written consent of the lessee.

This clause is in contravention of section 21 (1), (3) (e) and 3 (i) of the Act unless an exemption is granted under section 25 (1), hence the application.
