THE EAST AFRICAN COMMUNITY CUSTOMS MANAGEMENT ACT, 2004

(No. 1 of 2005)

EXEMPTION

IT IS NOTIFIED for the general information of the public that in pursuit of powers conferred on the Cabinet Secretary under section 114 (2) of the East African Community Customs Management Act, 2004 and in consequence of the declaration by the President and Commander in Chief of the Kenya Defense Forces of a national disaster through Executive Order No.1 of 2017, duty shall not be charged for the importation of the items set out in the Schedule hereto.

SCHEDULE

PART A—ITEMS THAT MAY BE IMPORTED DUTY FREE

1. The companies listed in the second column of Part B of this Schedule may import yellow maize in the corresponding quantities set out in the third column for use in the manufacture of animal feeds.

2. The yellow maize shall meet the following conditions—

(a) it shall not be genetically modified in accordance with the standards applicable in the European Union;

(b) it shall have a moisture content not exceeding 14.5%;

(c)  it’s aflatoxin levels shall not exceed 10 parts per million;

(d) it shall be accompanied by a certificate of conformity issued by a company appointed by the Kenya Bureau of Standards;

(e)  it shall be taken directly to a factory used for the manufacture of animal feeds immediately it arrives and is cleared in Kenya; and

(f)   it shall have been imported on or before the 31st August, 2017.

3. The importers of the yellow maize shall, before the importation of the yellow maize, register with the Kenya Bureau of Standards for this purpose.

4. Any person may import white maize if it meets the following conditions—

(a) the white maize shall not be genetically modified in accordance with the standards applicable in the European Union;

(b) it shall have a moisture content not exceeding 14.5%;

(c)  it’s aflatoxin levels shall not exceed 10 parts per million;

(d) it shall be accompanied by a certificate of conformity issued by a company appointed by the Kenya Bureau of Standards; and

(e)  it shall have been imported on or before the 31st July, 2017.

5. Any person may import dates during the month of Ramadhan.
