1.Patrick Mburu, the Accused, is charged with the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code. Particulars of the offence being that on the 12th May, 2017, he murdered Sabina Juma. The offence was alleged to have been committed within Korogocho area.
2.PW2 Dr. Peter Muriuki Ndegwa, who conducted a postmortem examination on the body of the deceased on the 17th May, 2017, concluded that the cause of death was exsanguination haemorrhage due to vascular injuries due to penetrating stab wound. This was evidence of death having occurred. In the celebrated case of Ramanlal Trambaklal Bhatt -Vs- Republic  E.A 332, it was stated that:
3.Evidence adduced by PW4 Martha Waceke, PW5 Lucia Njoki, and, PW7 George Mwangi, eye witnesses establish the fact of the deceased having been stabbed by the accused herein who was pursued and arrested following the act that resulted into the demise of the deceased.
4.In the result, I am satisfied that the prosecution has demonstrated a prima facie case against the accused as defined in the case of Bhatt -Vs- Republic (supra) that requires him to address the court in his defence, pursuant to the provisions of Section 306(2) of the Criminal Procedure Code.
