1.The ruling pending determination is an objection to production of a document by DW 1, Mr. Matemo on the basis that Section 34 and 37 of the Evidence Act is not applicable.

2.The objection is sustained on the ground that DW 1 does not work with EACC and he will not be able to answer questions on the said document.

3.The defendants are at liberty to call the custodian of the said document to produce it.

4.The hearing of this case will proceed on 19/10/2023 as scheduled.
