7.Facts: As per PBA: On March 10, 2014 Accused was at home when deceased visited. They then visited the deceased’s brother up to 9.00 pm. Whilst there at about 10 pm he heard the sister, Teresia Mbithe Mutunga scream that the Accused had stabbed her with a knife.
8.He rushed her to Embu Hospital where she was pronounced dead on arrival.
9.Post mortem: Cause of Death: Cardiopulmonary arrest due to hemorrhage secondary to stab wound.
10.Dated March 25, 2014; Medical Superintendent Embu Hospital.
11.POR: Dated October 28, 2022 Recommends accused as suitable for non-custodial sentence by was of a Probation Order; Recommends Counselling in Conflict Management, Anger Management, and to be facilitated in reconciliation. Filed November 1, 2022.
