1.The accused herein was charged with murder but convicted of a lesser offence of manslaughter contrary to section 202 as read with section 205 of the Penal Code.
2.I have considered the pre-sentence report and the mitigating factors disclosed to this court. I note that the Probation Officer has suggested a probation sentence. In my view however, a non-custodial sentence is not appropriate herein. An innocent life has been lost and the matter proceeded to full trial.
3.I sentence the accused herein to five (5) years imprisonment. In this regard, I am aware that this is a 2017 case. It is so ordered.
