REPUBLIC OF KENYA
IN THE HIGH COURT OF KENYA AT MERU
CRIMINAL CASE NO. 55 OF 2013
REPUBLIC ……………………………………………….. PROSECUTOR
VERSUS
MARTIN KIMATHI ……....……………….…………………… ACCUSED
SENTENCE
I have considered the able mitigation made on behalf of the accused. That he is a first offender. That he is remorseful. I have considered the period he has been in custody.
I have also considered the Victim Assessment Report and Pre-sentence Report filed on 15/5/2017.
I have considered that through his action, a life was lost. I have considered that the maximum sentence is life for the offence.
Taking into consideration all the foregoing, I sentence the accused to seven (7) years imprisonment.
DATED, SIGNED AND DELIVERED THIS 17TH DAY OF MAY, 2017.
A. MABEYA
