RULING ON SENTENCE

1. The deceased was the accused’s son whom she gave birth to while in school.  The child was aged 2 years and 3 months prior to his death.
2. It is the parents of the accused who were taking care of  both the child and the accused.
3. She was convicted of manslaughter after a plea bargaining arrangement.
4. She has been in custody for about 9 months.  She ought to have acted in a more responsible manner, as a mother.
5. I have considered the mitigation and the Probation Officer’s report.

She is sentenced to four (4) years which will be served as follows;

1. The first two years to be served in prison

2. The balance to be served on Probation under the supervision of the County Probation officer Kericho.
