Civil Practice and Procedure – review – Mortgage suit – Judge dismissing suit for non-compliance with the provisions of the law – judge relying on amended provisions of law - whether Judge’s reliance on amended provision constituting an error apparent on the face of the record – whether review lies against the Judge’s interpretation of the Law.
The applicant had filed a suit which was dismissed by the learned Judge for non-compliance with section 3(d) of the Mortgages (Special Provisions) Act, Cap 304. The applicant alleged that the said provision had long been amended by the Finance Act and therefore that the Judge’s reliance on it constituted an error apparent on the face of the record and made the present application for review of dismissal.
Held:
1. The alleged error involved a point of law which could not be subject to review but appeal to the Court of Appeal in respect of whether the trial Judge’s interpretation was correct or not.
2. The Court being of equal Jurisdiction had no power to entertain such an issue.
Application dismissed with no orders as to costs.
