Criminal Practice and Procedure - appeal – summary rejection of appeal – petition disclosing grounds other than excessive sentence and insufficient evidence – whether appellant entitled to full hearing of appeal – grounds upon which summary rejection can be ordered - power of the Court of Appeal in an appeal against a summary rejection.
The appellant was charged and convicted in a magistrate’s court for the offence of causing grievous harm contrary to s. 234 of the Penal Code. His appeal to the High Court was summarily rejected. He appealed to the Court of Appeal against summary rejection of his appeal.
Held:
1. The power of summary rejection of appeal under s. 352 (2) of the Criminal Procedure Code is strictly limited to cases where the appeal is brought only on the ground that the conviction is against the weight of evidence or that the sentence is excessive.
2. Since the petition disclosed other grounds other than excessive sentence, the appellant was entitled to the benefit of a full hearing by the Superior Court.
3. It would not be proper for the appellate court, in this case, to consider the full merits of the appellant’s grounds in his petition to the Superior Court.
Appeal allowed. Appeal remitted to hearing before the Superior Court.
