Damages – assessment of special and general damages – running down cases – calculating the multiplier – whether Kenya courts can adopt the approach taken by Foreign Courts.
The appellant appealed against the decision of the High Court in which the court entered judgment against it with respect to special and general damages. The judgment arose out of a road accident in which the respondent’s son was killed. Liability was not in issue. The applicant however submitted that the judge should have taken several factors into consideration such as the vicissitudes of life, age of deceased, and marital status which would have effectively reduced the quantum awarded. He urged the court to adopt the approach by Hong Kong Courts where multipliers used were below 10, mostly between 5 to 7 rather than the haphazard and arbitrary Kenyan approach.
Held:
1. Kenyan courts should exercise caution in adopting awards by foreign courts as they do not represent the standards which should prevail in Kenya where the conditions for such assessment are different.
2. The judge did not apply a wrong principle in assessing damages in the manner he did.
3. It was obvious that our local situation had little comparison whether social, economical or cultural, with Hong Kong.
