Civil Practice and Procedure – extension of time– to file memorandum and record of appeal – discretion of court in extending time – when delay in filing payment caused by ill health and inability to raise funds.
The applicant, a long suffering invalid, applied for an extension of time within which to file and serve his Memorandum and Record of Appeal. He made the application on the grounds of inability to instruct his advocates on time due to ill health and the inability to raise the filling fees.
Held:
1. The delay in filing and serving the Memorandum and Record of Appeal was satisfactorily explained.
2. The court would use its discretion to enlarge the time within which to file and serve the Memorandum and Record of Appeal.
Application allowed, costs to abide in the outcome of the intended appeal.
