(Appeal from the judgment and decree of the High Court of Kenya at Nairobi (The Honourable Mr Justice Mitey) dated the 22nd day February, 2000 in HCCC No 1750 of 1995)
Employment Law - wrongful dismissal from employment – whether damages may be awarded for period exceeding that specified in employment contract – contract providing for termination on grounds of misconduct or gross misconduct–– whether termination may be on other grounds.
Mortgages & Charges - statutory right of sale - when court can interfere with the exercise of the right - where the right has not arisen or is being exercised oppressively.
The respondent was an employee of the Central Bank of Kenya (the appellant) on permanent and pensionable terms. The respondent challenged his dismissal, on the grounds that it was in breach of the rules of natural justice. He also challenged the appellant’s action in advertising for the sale of a house which he had purchased with a loan obtained from the Bank and for which he had executed a charge in the Bank’s favour.
Held:
1. A contract of employment terminable by giving three months notice or three months salary in lieu of notice, if breached entitles the aggrieved party to damages restricted to the period of the notice.
2. Notwithstanding the absence of a provision in the Staff Regulations of the Central Bank giving the appellant the right to terminate the employment of an employee on permanent or pensionable terms by giving notice, the right to do so is available by reason of section 14(5) of the Employment Act (Cap 266).
3. A statutory right to terminate an employment contract cannot be taken away by a mere stipulation in Staff Rules and Regulations.
4. A trial judge can only interfere with a statutory right of sale if the evidence placed before him shows that either the right had not arisen on that it was being exercised oppressively.
Appeal allowed.
