TORT negligence plaintiff brought the suit as a representative of the estate of the deceased against the defendant for damages where the deceased and the plaintiff were both involved in the road accident which killed the deceased while in the private vehicle of the defendant the plaintiff suffered dislocation of left shoulder, fracture of mid-shaft left femur, deep cut wound of left leg, severe pains in central chest, concussion to the head leading to loss of consciousness for about 15 hours vicarious liability where the defendants driver carried the passenger contrary to company policy whether the owner of the motor vehicle is liable for the deceaseds death quantum of damages
